RESOLUTION NUMBER 2550
A RESOLUTION relating to the authorization of non-compliance with the Rear Yard
Requirements of Ordinance Number 5549, for the West One Half of Lot 3, on State
Street, Plat "B" in the City of Salina, Saline County, Kansas Known as Address
517 State Street.
WHEREAS, Glenn E. Moon, of Salina, Kansas, did apply for a certain building
permit relating to the utilization of the West One Half of Lot 3, of State
Street, Plat "B" in the City of Salina, Saline County, Kansas, known as Address
517 State Street.
WHEREAS, the Building Inspector of the City of Salina, Kansas, did refuse to
grant said permit for the reason that non-compliance with the Rear Yard
Requirements of Ordinance Number 5549 of said City, and
WHEREAS, Glenn E. Moon, did appeal from such refusal to the Board of Zoning
Appeals of the City of Salina, Kansas, and have a hearing relating thereto; and
WHEREAS, said Board did order that a hearing be had on said appeal and did
direct that notice be duly published informing the public that said hearing would
The held; and
WHEREAS, said notice was duly published and no persons appeared to protest the
variance from the requisites of said Ordinance, and so now, therefore
BE IT RESOLVED by the Board of'Commissioners of the City of Salina, Kansas
That Glenn E. Moon, should be and is hereby authorized to utilize the full area
of the lot described as aforesaid for the purpose of constructing and installing
thereon facilities for his use in his program to the extent that the Rear Yard
Requiren ent are waived on the above mentioned property, and:that such variance
is hereby determined to not be contrary to the public interest and that
substantial justice will be done by such authorized variance, and that such
authorization is consistent with the intent and purposes of the Zoning Ordinances
of the City of Salina;Kansas.
