A RESOLU'T'ION relating to the authorization of non-compliance with the Front Yard:,
Requirements of Ordinance Number•5549, for East_50 feet of Lot 4, Surveyors
Plat 8, in the City of Salina, Saline County, Kansas.
WHEREAS, Dan Bolen, of Salina, Kansas, did apply for a certain building permit
relating to the utilization of East 50 feet.of Lot 4, Surveyor's, Plat 8, in the
City of Salina, Saline County, Kansas.
WHEREAS, the Building Inspector of the City of Salina, Kansas, did refuse to
grant said permit for the reason that non-compliance with the Front Yard
Requirements of Ordinance Number 5549 of said City, and
WHEREAS, Dan Bolen, did appeal from such refusal to the Board of Zoning Appeals
of the City of Salina, Kansas, and havea hearing relating thereto; and -
WHEREAS, said Board did order that a hearing be had on said appeal and did
direct that notice be duly published informing the public that said hearing
would be held; and
WHEREAS, said notice was duly published and no persons appeared to protest the
variance from the requisites of said Ordinance, and SO NOW, THEREFORE
BE IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas:
That Dan Bolen, should be and is hereby authorized to utilize the full area of
the lot described as aforesaid for the purpose of constructing and installing
thereon facilities for his use in his program to the extent that the Front Yard
Requirements are waived on the above mentioned property, -and that such variance
is hereby determined to not be contrary to the public interest and that-substant
justice will be done by such authorized variance, and that such authorization is
consistent with the intent and purposes of the Zoning Ordinances of the City of
Salina, Kansas.
