2484 Advisability ImprovementsA RESOLUTION determining the advisability of certain street, sewer, water mains and hydrant improvements, estimating the cost thereof, defining the boundaries of the improvement district, method'of assessment, and apportioning the cost between the improvement district and the City at large. WHEREAS, the public hearing on the advisability of the following improvements, to -wit: 1. This improvement consists of the curbing, guttering and paving of: (a) Magnolia Road, from the west line of Belmont Boulevard to the east line of U. S. 81 By-pass. (b) Belmont Boulevard, from the north line of Magnolia Road to the south line of Parkway Avenue. (c) Hart Street, from the west line of Belmont Boulevard to the east line of Gebhart Street. o (d) Fourth Street, from the south line of Parkway Avenue'to the south line of Hart Street. (e) Reed Avenue; from the west line of Belmont Boulevard to the east line of Larson Street. (f) Parkway Avenue, from the west line of Fourth Street to the east line of U. S. 81 Highway. (g) Highland Avenue, from the south line of Magnolia Road to the north line of Parkway Avenue. (h) Simmons Street, from the south line of Magnolia Road to The north 1 ne of Parkway Avenue. (i) Larson Street, from the south line of Magnolia Road to the north line of Parkway Avenue. (j) Gebhart Street, from the south line of Magnolia Road to the north line of Reed Avenue. 2. Water main to be installed in all the above described streets. 3. The sanitary sewer to serve all of Blocks 1, 2, 3, 4, 5, 6, 7, 8, 12, 27, 28, 29 and Lots 1, 12, Block 9, Lots 1, 2, 3, 9, 10, Block 10 and Lots 1, 2, '3, 10,111, Block 11, Key Acres Addition. was held as provided by Resolution Number 2479 adopted and approved by the Board of Commissioners of the City of Salina, Kansas, on the 14th day of March, 1961; WHEREAS, notice of public hearing on the advisability of the said improvement has been published in the Salina Journal, the official city newspaper, on the 17th day of March, 1961, and the 24th day of March, 1961, as provided by said Resolution and G. S. 1959,ISupp. Sections 12-6a01 to 12-6al8, State of Kansas. WHEREAS, the Board of Commissioners of the City of Salina, Kansas, met in the Commissioners Room at the City Hall on the 4th day of April, 1961, at 4:00 o'clock P. M. for the purpose of conducting a public hearing on the advisability of said improvements, said hearings were finally adjourned on the 4th day of April, 1961, all as provided by law. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS: Section 1, That the Board of Commissioners of the City of Salina, Kansas, hereby finds and finally determines that: A. It is advisable t© make the following improvements, to -wit: 1. This improvementslconsists of the curbing, guttering and paving of: (a) Magnolia Road, from the west line of Belmont Boulevard . to the east line of U. S. 81 By -Pass. (b) Belmont Boulevard, from the north line of Magnolia Road to the south line Qf Parkway Avenue. (c) Hart Street, from the west line of Belmont Boulevard to the east line of Gebhart Street. (d) Fourth Street, from the south line of Parkway Avenue to the south line of Hart Street. += (e) Reed Avenue, from the west line of Belmont Boulevard to the east line of Larson Street. (f) Parkway Avenue, from the west line of Fourth Street to the east line of U. S. 81 Highway. (g) Highland Avenue, from the south line of Magnolia Road to the north line of Parkway Avenue. (h) Simmons Street, from the south line:of Magnolia Road to the north line of Parkway Avenue. (i) Larson Street, from the south line of Magnolia Road to the north line of Parkway Avenue. (j) Gebhart Street, from the south line of Magnolia Road to the north line of Reed Avenue. o 11 2. Water main to be installed in.all the above described streetw. 3. The sanitary sewer to serve all of Blocks 1, 2, 3, 4, 5, 6, 7, 8, 12, 27, 28, 29 and Lots 1, 21,.Block 9, Lots 1, 2, 3, 9, 10, Block 10 and Lots 1, 2, 3, 10, 11, Block 11, Key Acres Addition. B. The estimated or probable cost of such improvements is $472,371.24. C. The extent or boundaries of the proposed improvement district to be ssessed is: That part of the City of Salina,Saline County, Kansaq, described as follows: -wit: (1) Beginning at a poinr 200.0 feet north of Magnolia Road which is alos the north line of the northwest quarter of Section 36, Township 14, South, Range 3, West ofthe 6th.PM; (2) thence west on a line 200.0 feet north of said quarter section to the east right-of-way line of U.. S.•.81.,Highway; (3) Thence south along the said east right-of-way to a point directly west of the south line of Lot 13, Block 9 of Key Acres Addition. (7) thence south on lot lines to a point 35 feet south of the nnrth line of Lot 5, Block 10 of said Key Acres Addition; (8) thence east to center line of Simmons Street; (9) thence south to a point 14.2 feet south of the north line of Lot 13, Block 11 of said addition; (4) thence east along south line of said Lot 13 and continuning eastton same.line to the center -line of Highland Avenue; (5) thence north along the center line of said Highland Avenue to a point 34.6 feet south of the north line of Lot 11, Block 10 of -Key Acres -Addition. . (6) thence east to the back of said Lot 11; (7) thence south on lot lines to a point 35 feet south of the nnrth line of Lot 5, Block 10 of said Key Acres Addition; (8) thence east to center line of Simmons Street; (9) thence south to a point 14.2 feet south of the north line of Lot 13, Block 11 of said addition; (10) thence east to back of said Lot 13; (11) thence south on lot lines to a point 59 feet south of the north line of Lot 5, Block 11 of said addition; (12) thence east to east line of said Lot 5; (13) thence southeasterly along the center line of Hartland Avenue to the center line of Fourth Street; (14) thence north along the center line of Fourth Street to a point directly west of the south line of Lot 18, Block 29 of Key Acres Addition. (15) thence east along the south line of said Lot 18 to the west right-of-way of Union Pacific Railroad; (16) thence north along said right-of-way to a point 200.0 flet north of Magnolia Road or the point of beginning. D. -The proposed apportionment of cost between the improvement district and the City at large is as follows: 1. Costs Chargeable to Private Propetty: (1) All of sanitary sewers including lift stations. (2) Stub outs under pavements for water and.sanitary sewers. (3) Storm Sewer inlets which are contingent to pavement including connection pipes to manhole's. (4) 90% of all other such as pavements, grading, sidewalks and water mains that serve lots. 11 1 II. Chargeable to City at Large: (1) Extra width of pavement in excess of 40 feet face to face. (2) Storm Sewers except (3) above. (3) Fire Hydrants. (4) Water circulation mains. (5) 10% of all other such as pavements, grading, sidewalks and water mains that serve lots. E. The assessments with accrued interest shall be levied as a special tax upon the property included therein concurrent with the general property taxes and shall be payable in Ten (10) equal annual installments. F. The method of assessment shall be made on the square foot basis, the assessment against each lot, piece or parcel of land shall be made in direct proportion to its fraction of the total area of property deemed benefited. Section 2. BE IT FURTHER RESOLVED that the public hearing on the advisability of the improvement set out in Section 1, hereof, is hereby finally adjourned.
