RESOLUTION NUMBER 2662

A RESOLUTION determining the advisability of certain street, sewer, water
mains and hydrant improvements, estimating the cost thereof, defining the
boundaries of the improvement district, method of assessment; and apportioning
the cost between the improvement district and the City at Large.
WHEREAS. the public hearing on the advisability of the following improve-
ments to -wit:
1. The curbing, guttering and paving with concrete, 33 feet wide
from back of curb to back of curb, Westhcester Drive, from the
east line of Berkshire Drive to the west line of Delaware Aveenue.
The curbing, guttering and paving with concrete, 33 feet wide,
from back of curb to back of curb, Berkshire Drive from -the
south line of Westchester Drive to the west line of Delaware
Avenue.
The curbing, guttering and paving with concrete, 33 feet wide,
from back of curb to back of curb, Elmhurst Drive from the
east line of Ohio Street to the west line of Delaware Avenue.
The curbing, guttering and paving with concrete, 33 feet wide,
from back of curb to back of curb, Delaware Avenue from the
south line of Stratford to the south line of Elmhurst Drive.
2. Water main to be installed in the above described streets
with a 1 inch copper service stubbed out at each lot.
3. Sanitary sewers to serve south part of Block.7, all of
Block 9, and all of Block 10.
was held as provided by Resolution Number 2651 adopted and approved by the Board
of Commissioners of the City of Salina, Kansas, on the llday of September, 1962.
WHEREAS, notice of public hearing on the advisability of the said improve-
ments has been published in The Salina Journal, the official city newspaper, on
the 25th day of September, 1962 and the 2nd day of October, 1962 as provided by
said Resolution and G. S. 1959, Supp. Section 12-6a01 to 12-6al8, State of Kansas.
WHEREAS, the Board of Commissioners of the City of Salina, Kansas, met in
the Commissioners Room at the City Hall on the 9th day of October, 1962 at 4:00
o'clock P. M. for the purpose of conducting a public hearing on the advisability
of said improvements, said hearings were finally adjourned on the 9th day of
October 1962 all as provided by law.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF - THE CITY OF
SALINA, KANSAS:
Section 1. That the Board of Commissioners of the City of Salina, Kansas,.
hereby finds and finally determines that:
It is advisable to make the following improvements, to -wit:
1. The curbing, guttering and paving with concrete, 33 feet
wide, from back of curb to back of curb, Westhcester Drive
from the east line of Berkshire Drive to the west line of
Delaware Ave.
The curbing, guttering and paving with concrete, 33_feet wide,
from back of curb to back of curb, Berkshire Drive from the
south line of Westchester Drive to the west line of Delaware
Avenue.
The curbing, guttering and paving with concrete, 33 feet wide,
from back of curb to back of curb, Elmhurst Drive from the
east line of Ohio Street to the west line of Delaware Avenue.
The curbing, guttering and paving with concrete, 33 feet wide,
from back of curb to back of curb, Delaware Avenue from the
south line of Stratford to the south line of Elmhurst Drive.

2. Water main to be installed in the above described

of Block 9 and all of Block 10.
The extent or boundaries of the proposed improvement district to be
assessed is:
That part of the City of Salina, Saline County, Kansas described as
follows, to -wit:
1. Beginning at a point which is 39.74 feet west of the
northeast corner of -Lot 3, Block 8, Replat of Indian Rock
Addition,
2. thence south parallel to.lot lines to the back line
of said Lot 3,
3. thence west following the back lot lines to the east
line of Berkshire Drive,
4. thence south along the east line of Berkshire Drive
to the south line of Westchester Drive,
5. thence west along the south line of Westchester Drive
to the east line of Ohio Street,
6. thence south along Ohio Street to the south line of
Elmhurst Boulevard,
7. thence southeasterly and then northeasterly following
the south line of Elmhurst Boulevard to the east line of
Block 7, Replat of Indian Rock Lane.
8. thence northerly following the east line of .said,
Block 7 to the north line of Lot 6 .in said Block,
9. thence west and crossing Delaware Avenue following
the north line of Lot 5, 4 and part of Lot 3, Block 8
to the point of beginning.
The estimated or probable cost of such improvements is $71,852.00.
The proposed apportionment of cost between the improvement district
and the City at Large is as follows:
1. Costs Chargeable to Private Property in the amount
of $62,082.00 or approximately 86.40 per cent.
2. Costs Chargeable to the City at Large in the amount
of $9,770.00 or approximately 13.60 per cent.
3. The assessments with accrued interest shall be levied
as a special tax upon the property included therein
concurrent with,the general property taxes and shall be
payable in.Ten (10) equal annual installments.
4. The method of assessments shall be based on the area
of each -lot or parcel of ground within the benefit district
with adjustments -:made for unusual shaped lots with extreme
depths. For the purpose of these calculations the lot
widths used will be measured at the building line at
25 feet or at 50 feet, (whichever gives the lesser width
on other than rectangular lots) times the depth which
for these lots iAll be all 110 feet.
Section 2. BE IT FURTHER RESOLVED that the public hearing on the
advisability of the improvement set out in Section 1 hereof, is hereby
finally adjourned.
