3117 Order Improvements1 1 1 RESOLUTION NUMBER 311.7 (Published in The Salina Journal January 14 1972) A RESOLUTION authorizing and ordering certain street, water main, sanitary sewer and storm sewer improvements, ordering preparation of plans and specifications,. and the estimate of costs. WHEREAS, -the public hearing on the advisability of the following improvements, to -wit: The installation of paving on Woodland Avenue with 6 inch reinforced concrete from Second Street to .Third Street. The installation of a water main in Meadowlark Lane from Mars Avenue to Saturn Avenue. The'installation of curbing, guttering, concrete pavement, water main, sanitary sewer and drainage system in Bobby Place, Mike Drive and Bret Avenue from Neal Avenue to the north line of Bonnie Ridge Addition. - The installation of a sanitary sewer to.serve a tract of land 400' x367' in the Northwest Quarter.of Section. 7, Township 14 South, Range 2 West. The.installation of curbing, guttering,ppaving and grading of Faith Drive from Meadowbrook Road to the east line of Lot 15, Block 9, Replat of Faith Addition. The installation of water main, curbing, guttering, paving and grading of Prospect Avenue from Ohio Street to a point. 5 feet west of the east line of Lot 10, Cloverdale Annex. The installation of a water main in Stimmel Road from U. S. 81.Highway, East 876 feet The installation of a sanitary sewer and water main in Diamond Drive.from U. S. 81 Highway, West approximately 1,320 feet. was held as provided by Resolution Number 3115, adopted and approved by the Board of Commissioners of the City of Salina, Kansas, on the 13th day of December, 1971. WHEREAS, notice of public hearing on the advisability of the said improvements has been published in The Salina Journal, the official city newspaper, .on the 20th day of December, 1971, and the 27th day of December, 1971, as provided by said Resolution and K.S.A. Sections 12-6a01 to 12-6a18. WHEREAS, the Board of Commissioners of the City of Salina, Kansas, met in the Commissioners' Room in the City -County Building on the 3rd day of January, 1972, at 4:00 o'clock for the purpose of conducting a public hearing on the advisability of said improvements, said hearings were finally adjourned on the 3rd day'of January, 1972, all as provided by law. WHEREAS, six'(6) months have not elapsed since the final adjournment of said public -hearings. NOW THEREFORE, BE IT RESOLVED BY THE 'GOVERNING BODY OF THE CITY OF SALINA, KANSAS Section 1. That the following improvements be and the same are hereby authorized and ordered to be made in accordance with the findings of the Board of Commissioners of the City of Salina, Kansas, upon the advisability of the improvements, to -wit - The installation of paving on Woodland Avenue with 6 inch reinforced concrete from Second Street to Third Street. The installation of a water main in Meadowlark Lane from Mars Avenue to Saturn Avenue. The installation of curbing, guttering, concrete pavement, water main, sanitary sewer and drainage system in Bobby Place, Mike Drive and Bret Avenue from Neal Avenue to the north line of Bonnie Ridge Addition. The installation of a sanitary sewer to serve a tract of land 400' x 367''in the Northwest Quarter of Section 7, Township 14 South, Range 2 West: The installation of curbing, guttering, paving and grading of Faith Drive from Meadowbrook Road to the east line of Lot 15, Block 9, Replat of Faith Addition. The installation of water main, curbing, guttering, paving and grading of Prospect Avenue from Ohio Street to a point 5 feet west of the east line of Lot 10, Cloverdale Annex. The installation of a water main in Stimmel Road from U. S. 81 Highway, East 876.feet. The installation of a sanitary sewer and water main in Diamond Drive from U. S. 81 Highway, West approximately 1,320 feet. The extent or boundaries of the proposed improvement district to be assessed is: That part of the City of Salina, Saline County, Kansas, described as follows, to -wit: Lots 11 through 20, Block 5; and Lots 1 through 10 and the north half of Lots 11 and.12, Block 6, Woodland Addition. Lots 1, 2, 18, 19, 20, 21 and 22, Block 12; Lots 10, 11, 12, 13 and 14, Block 13; Lots 7 and 8, Block 14; Lots 1 through 12, Block 15, Wallerius Addition. Lots 1 through 13, 131ock 8; Lots 1 through 12, Block 9; Lots 5 through 10, Block 2, Bonnie Ridge Addition. Commencing at the west quarter corner of Section 7, Township 14 South, Range 2 West; thence east along the center line of North Street, a distance of 1198.87 feet, and assuming the bearing of said line to be N 90° 00' 00" E; thence in a southerly direction along a bearing of S 0° 02' 37" W, a distance of 35.00 feet to an Iron Pin and said Iron Pin being on the South right-of-way line of North Street and said point also being the point of beginning: 1.. Thence continuing in a southerly direction along a bearing of W 0° 02' 37" W, a distance of 367.380 feet to an Iron Pin; 2. Thence in a westerly direction along a bearing of S 89° 11' 47" W, a distance of 400.00 feet to an Iron Pin; 3. Thence in a northerly direction along a bearing of N 0° 02' 13" E, a distance of 372.990 feet to an Iron Pin and said point beging on the south right- of-way line of'North Street; The West 44 feet of the South half of Lot 17, and the South half, of Lots 18 and 19, and all of Lots 20 and 21, Block 1, Cloverdale Addition; and the West 65 feet of Lot 10, all of Lots 11, 12, 13, 15, 16, and the North 21 feet of Lot 14, Cloverdale Annex. Beginning at a point 314 feet east of the southwest corner of said Section 36; 2. Thence North 338.9 feet; 3. Thence East and parallel to the south line of said Section 36 to the center line of old Dry Creek; 4. Thence Southeasterly down the center of old Dry Creek to a point 876 feet east of the west line of said Southwest Quarter of Section 36; 5. Thence South parallel to the west line of said Section to the south line of said Section 36.; 6. Thence West along the south line of Section 36 a distance of 17 feet; 7. Thence South 319.9 feet; 8. Thence West and parallel to the south line of Section 36, a distance of 460 feet; 9. Thence north 319.1 feet to the south line of said Section 36; 10. Thence west to the point of beginning. Beginning at a point on the south.line of the Northeast Quarter of Section 35, Township 13 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, that is located 470 feet west of the southeast corner of the Northeast Quarter of said Section 35; 1. Thence North 300 feet; 4. Thence in an easterly direction along a bearing of N 900 M` 00" E, and said line being along the south right-of-way line of North Street, a distance of 400.00 feet to the point of beginning. Lots 13, 14, and 15, Block 9; and Lot 1 and West 45 feet of Lot 12, Block 8, Replat of Faith Addition. Thence North 300 feet; 1 2. Thence West 916 feet; 3. Thence South 300 feet to the south line of the Northeast Quarter of said Section 35; 4. Thence Wiest 134 feet; 5. Thence South 581.3 feet to the north right-of-way line ata .a point that is 400 feet west of the east line of said.Section 35; 6. Thence North to the south line of the. Northeast Quarter of said Section 35; T. Thence West 70 feet to the point of beginning. The estimated or probable cost of such improvement is $174,298.02. The proposed apportionment of cost between the improvement district and the City -at -large is as follows: 1. Costs chargeable to Private Property in the amount of $158,119.77• 2. Costs chargeable to the City -at -large in the amount of $16,178.25 3. The assessment, with accrued interest, to be levied as a special assessment tax upon the property included within the benefit district, concurrent with the general property tax_and shall be payable in ten equal annual installments. 4. The method of assessment shall be based -on the front footage of each lot or parcel of land and without regard to the buildings or improvement. of the land. Section 2. That the City Engineer be and he is hereby directed and ordered to prepare plans and specifications, and estimates of the cost of said improvements by the 14th day of February, 1972. Section 3. That the said improvements shall not be commenced, if within twenty 20 days after publication of the Resolution, written protests by both fifty-one (51) percent or more of the resident owners of record of property within the improvement district and the owners of record of more than one-half of the total area of such district, are filed with the City Clerk.
