02-5854 Advis Woodland HillsRESOLUTION NUMBER 02-5854 A RESOLUTION OF FINDING AS TO THE ADVISABILITY OF CONSTRUCTION PURSUANT TO K.S.A. 12-601 et seq. OF AN IMPROVEMENT CONSISTING OF CERTAIN CURBING, GUTTERING, PAVING, GRADING AND STORM DRAINAGE IMPROVEMENTS IN THE WOODLAND HILLS ESTATES ADDITION TO THE CITY OF SALINA, KANSAS. Pursuant to findings of advisability made by the Governing Body of the City of Salina, Kansas. WHEREAS, a petition was filed with the City Clerk on the 1" day of August 2002, under and pursuant to K.S.A. 12-6a01 et seq. to make certain curbing, guttering, paving, grading, and storm drainage improvements in Woodland Hills Estates Addition. WHEREAS, due to the findings by the City of Salina that the tract on the south side of Brookwood Lane is bisected by a major drainage channel and easement that serves off-site properties, this tract is deemed undevelopable and receives no benefit from these improvements and is excluded from the benefit district. WHEREAS, based on the public benefit involved the city -at -large intends to pay from the city -at -large share the appropriate equivalent lot costs for the tract on the south side of Brookwood Lane for the Brookwood Lane drainage crossing and the Brookwood Lane street construction. NOW, THEREFORE, be it resolved by the Governing Body of the City of Salina, Kansas, that the following findings as to the advisability of making certain curbing, guttering, paving, grading, and storm drainage improvements in Woodland Hills Estates Addition of the City of Salina, Kansas, are hereby made, to wit: Section 1. That it is necessary and in the public interest to make an improvement consisting of: WOODLAND HILLS ESTATES ADDITION (PHASE IV) Curbing, guttering, paving, grading and drainage of Brookwood Lane from the east property line of Lot 1, Block 2, Woodland Hills Estates Addition to 40 foot east of the east property line of Lot 1, Block 3 to serve Lots 22 — 28, Block 2 and Lots 1 — 7, Block 3, Woodland Hills Estates Addition; Installation of a drainage channel crossing under Brookwood Lane at the east line of Lot 1, Block 3, Woodland Hills Estates Addition to serve Lots 22 — 28, Block 2 and Lots 1 — 7, Block 3, Woodland Hills Estates Addition. Section 2. That the estimated and probable cost of such improvement is $83,726. Section 3. That the Governing Body hereby further finds and finally determines that the boundaries of the improvement district against a portion of the costs of said improvement shall be assessed are hereby established and fixed as the following legal description: Lots 22 — 28, Block 2, Lots 1 — 7, Block 3, all in Woodland Hills Estates Addition to the City of Salina, Kansas. Section 4. The method of assessment is that 100% of the total cost assessed against the property shall be based upon equal assessments for each equivalent residential lot in the benefit district relative to the type of improvement and the sub -area by each improvement. Section 5. The proposed apportionment of cost between the improvement district and the city -at -large is: 1. The costs assessed against the improvement district shall be: a. 80.5% of the total cost of street and drainage improvements, including grading, pavement, curbs and gutters, storm inlets and any incidentals thereto to complete the residential street standard and drainage systems. GnaliMhC�SeNne b. 50% of the total cost of the drainage channel crossing under Brookwood Lane including culverts, earthwork, erosion control, and grading. 2. The costs assessed against the city -at -large shall be: a. 50% of the total cost of the drainage channel crossing under Brookwood Lane including culverts, earthwork, erosion control and grading. b. 19.5% of the total cost of street and drainage improvements including grading, pavement, curbs and gutters, storm inlets and any incidentals thereto to complete the residential street standard and drainage systems. Section 6. That the advisability of the improvements set forth above is hereby established as authorized by K.S.A. 12-6a01 et seg. Section 7. That the City Engineer be and is hereby directed and ordered to prepare plans and specifications, and estimates of the cost of said improvements. Section 8.
