ORDINANCE NUMBER 09-10504
AN ORDINANCE PROVIDING FOR THE VACATION OF CERTAIN
STREET RIGHT-OF-WAY OF HAGEMAN AVENUE, ADJACENT TO A PORTION OF
LOT SIX (6), PLAT TWO (2), OF THE LAMER'S 1sT SUBDIVISION, AN ADDITION TO
THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on June 15, 2009, the Salina City Commission conducted a public
hearing on the petition filed by Randall S. Baird ("Petitioner") requesting vacation of a portion of
street right-of-way in Hageman Avenue abutting a portion of Lot Six (6), Plat Two (2) of the
Lamer's 1St Subdivision, an Addition to the City of Salina, Saline County, Kansas, commonly
known as 1842 Hageman Avenue.
Section 2. That the governing body finds from the evidence presented at the public
hearing that:
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the right-of-
way.
(c) In justice to the Petitioner Randall S. Baird vacation of the right-of-way
should be granted.
Section 3. That a portion of street right-of-way in Hageman Avenue, abutting a
portion of Lot Six (6), Plat Two (2) of the Lamer's 1St Subdivision, an Addition to the City of
Salina, Saline County, Kansas, depicted in the attached Exhibit A, and more particularly described
as follows:
The right-of-way of Hageman Avenue, beginning at the. Southeast
corner of said Lot 6; Thence on an assumed bearing of North 0° 09'
48" West on the East line of said Lot 6, a distance of 84.52 feet;
Thence South 41* 45' 43" East, a distance of 12.05 feet; Thence
South 0° 09' 48" East parallel to the said East line, a distance of 75.50
feet; Thence South 89° 50' 12" West, a distance of 8.00 feet to the
Point of Beginning. Said Tract contains 640.08 square feet, more or
less.
is hereby vacated.
Section 4. That a public utility easement shall be retained in the above described
portion of street right-of-way on Hageman Avenue which is vacated by this ordinance.
Section 5. That the above described portion of street right-of-way on Hageman
Avenue which is vacated by this ordinance, shall revert entirely to Randall S. Baird, the owner of
the adjacent property more particularly described as follows:
The East Two Hundred and Forty-nine (E 249.0) feet of the South
One Hundred and Fifteen (S 115.0) feet of Lot Six (6), Plat Two (2),
Lamer's 1 st Subdivision, an Addition to the City of Salina, Saline
County, Kansas (commonly known as 1842 Hageman Avenue).
Section 6. That this ordinance shall be in full force and effect from and after its
adoption and publication once in the official city newspaper.
