3146 Authorize Nazarene Addition Improvements1 1 RESOLUTION NUMBER 3146 (Published in The Salina Journal 1973) A RESOLUTION authorizing and ordering certain curbing, guttering, paving and grading and water main improvements, ordering preparation of plans and specifications, and the estimate of costs. WHEREAS, a petition was filed with the City Clerk on the 2nd day of August, 1972; proposing certain concrete curbingV_guttering, paving and grading of Kirwin Avenue from the east curb line of Ohio Street to a.point 430 feet East; and WHEREAS, the Governing Body of the City of Salina, Kansas, did on the 21st day of August, 1972, find such petition to be sufficient; and WHEREAS, a petition was filed with the City Clerk on the 22nd day of January, 1973, proposing certain concrete; -paving and grading of Third Street from Mulberry Street south to the Smoky Hill River; and WHEREAS, the Governing Body of the City of Salina, Kansas, did on the 16th day of April, 1973, find such petition to be sufficient; and WHEREAS, a petition was filed with 'the City Clerk on the 20th day of February, 1973, proposing certain aspl a'Eli)t paving, curbing, and water mains for Dewey Street from the west lot lines of Lots 2 and 3, Brown.and Brown Addition to Bromac Street; and WHEREAS, the Governing Body of the City -,of Salina, Kansas, did on the 12th day of March, 1973, find such petition to be sufficient; and WHEREAS, a petition was filed with the City Clerk on the 10th day of April, 1973, proposing certain asphalt paving, curbing, guttering, and grading on Landmark Lane from the east line of Ohio Street to the south line of Block 4, Lakewood Addition; and . WHEREAS, the Governing Body of the City of Salina, Kansas, did on the 23rd day of April, 1973, find such petition to be sufficient; and WHEREAS, the Governing Body of the City of Salina, Kansas, did on the 21st day of May, 1973, duly adopt a resolution finding it advisable to make the aforementioned improvements under the provisions of Chapter 12, Article 6a of the Kansas Statutes Annotated, BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1, That the following Improvements are hereby authorized and ordered to be made in accordance with the findings of the Governing Body: Concrete Lu>rbing, guttering, paving and grading of Kirwin Avenue from the east curb line of Ohio Street to a point 430 feet East, Concrete paving and grading of Third Street from Mulberry Street south to the Smoky Hill River, Ashpaht paving, grading, and water mains for Dewey Street from the west lot lines of Lots 2 and 3, Brown and Brown Addition to Bromac Street, Asphalt paving, curbing, guttering, and grading of Landmark lane from the east line. of Ohio Street to the south line of Block 4, Lakewood Additiqn. FJ Section 2. The extent or boundaries of the proposed improvement district to be assessed is: That part of the City of Salina, Saline County, Kansas, described as follows, to -wit: Lot 1, Block 1, Nazarene Addition A tract of land lying in the Southwest Quarter (SW4) of Section Nineteen (19), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian, Saline County, Kansas, being more particularly described as follows: Starting at the southwest corner of said Section 19; Thence North EO} 00'00" East along the west line of said Section 19 a distance of 994.39 feet; thence North 90°00100" East a distance of 50.00 feet to the point of beginning; thence North 89°02130" East a distance of 471.50 feet; thence South 0000100" West a distance of 219.81 feet; thence South 89°02130" West a distance of 471.50 feet; thence North 0°00100" East a distance of 219.81 feet to the point of beginning, containing 2.38 acres, more or less. Lots 170, 172, 174, 176, 178, 180, 182, and 184 on Third Street, Original Towns'Ite. Lots 8 and 9, Surveyor's Plat "J" Lots 2 and 3, Brown and'Brown Addition Blocks 3, 4, 7, 8, and 9, Lakewood Addition Section 3. The estimated or probable cost of such improvements is $73,154.95. Section 4. The apportionment of cost between the improvement district and the City gait 41iages> is as follows: 1. Costs chargeable to private property in the amount of $65,261.35. 2. Costs chargeable to the City -at -large in the amount of $7,893.60. Section 5. The assessment with accrued interest, shall be levied as a special tax upon the property included within the benefit district, concurrent with the general property taxes and shall be payable in ten equal annual installments. Section 6. The method of assessment shall be based on the adjusted front footage or area of each lot of land and without regard to buildings or improvement of the land. Section 7. The City Engineer be and is hereby directed and ordered to prepare plans and specifications, and estimates of the cost of said improvements by the 11th day of June, 1973.
