GRANT OF PERMANENT UTILITY EASEMENT
Ryan Martuary, Inc., a Kansas carparatian, (the "Grantar"), being the awner afthe
hereinafter described real estate, daes hereby give, grant, dedicate, and canvey unto. the
City af Salina, Kansas, a municipal carparation, (the "Grantee")
A Permanent Utility Easement, in perpetuity, an the real estate legally described
an the attached and incorporated Exhibit A far the purpases aflacating,
constructing, excavating, and maintaining poles, wires, canduit, pipeline, and
junctian boxes far the purpose af conducting, transmitting, and distributing water,
sewage, electricity, gas and electronic cammunicatians by the City, its
franchisees, and its licensees.
Grantar acknawledges that this Grant afPermanent Utility Easement shall neither
alter nor affect the Grantar's abligation to maintain the described real estate.
Grantar hereby cavenants that they are the lawful awners af the described
premises and have the right, pawer, and authority to. canvey the rights granted hereby.

A parcel of land located in a vacated portion of Claflin Avenue right-of-way which adjoins the
South side of Lot 1, Block 1, both being ih Gile Addition to the City of Salina, Saline County,
Kansas, being 20.0 feet in width and being used for utility easement purposes and is more
particularly described as follows:
Commencing at the Northwest comer of Lot 1, Block 1, Meadow Pointe Addition to said City of
Salina; thence on an assumed bearing ofN 89055'19" E along North line of said Lot 1 a distance
of248.50 feet to the POINT OF BEGINNING of the parcel to be described;
- thence N 00000'00" E a distance of 17.13 feet to a point on the South line of a 20.0 foot utility
easement;
- thence N 89055'19" E along said South line a distance of 20.00 feet;
- thence S 00000'00" E a distance of 17.13 feet to a point on the North line of Lot 3, Block 1 of
