AN ORDINANCE PROVIDING FOR THE VACATION OF CERTAIN STREET
GHT-OF-WAY ON CLAFLIN AVENUE, ADJACENT TO A PORTION OF LOT ONE (1)9

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on January 12, 2009, the Salina City Commission conducted a public
ng on the petition filed by Stephen C. Ryan on behalf of Ryan's Mortuary, Inc. ("Petitioner")
-sting vacation of the remaining Claflin Avenue street right-of-way east of Ohio Street abutting Lot
(1), Block One (1) of the Gile Addition to the City of Salina, Saline County, Kansas.
Section 2. That the governing body finds from the evidence presented at the public hearing
(a) Due and legal notice has been given by publication as required by law
(b) No private rights will be injured or endangered by vacation of the right-of-way.
(c) Injustice to the Petitioner vacation of the right-of-way should be granted.
Section 3. That a portion of street right-of-way of Claflin Avenue, adjacent to a portion of
One (1), Block One (1), Gile Addition, to the City of Salina, Saline County, Kansas, and more
icularlv described as follows:
The right-of-way of Claflin Avenue beginning at a point 150'
east of the east right-of-way line of Ohio Street and extending
westerly back to the east right-of-way line of Ohio Street and
being 37.13 feet in width, more or less.
�s hereby vacated.
Section 4. That a public utility easement shall be retained on the above described portion
street right-of-way on Claflin Avenue which is vacated by this ordinance:
Section 5. That the above described portion of street right-of-way on Claflin Avenue
is vacated by this ordinance, shall revert to the adjacent property owner as follows:
1. The North 31.7.13' of that portion adjacent to Lot One (1), Block One (1), Gile
Addition shall revert entirely to the owner of Lot One (1), Block One (1).
Section 6. That this ordinance shall be in full force and effect from and after its adoption
publication once in the official city newspaper.
