ORDINANCE NUMBER 08-10473
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE
N NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE
ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR
W THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE
PROPER USES THEREOF; AND REPEALING ORDINANCE NUMBER 8505.
WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the
rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW,
THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. AMENDMENT. DISTRICT "PDD (C-2). PLANNED DEVELOPMENT
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as
a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby
amended so that the following described property be rezoned as follows, to -wit:
Lot Nine (9), Block One (1) in the Georgetown Villas Addition to the City of Salina,
Saline County, Kansas (formerly a part of Tract #3 of the Georgetown Village Place
PDD).
shall become a part of District "PDD (C-2)". PLANNED DEVELOPMENT DISTRICT.
Section 2. CONDITIONS OF APPROVAL. That the use of said described property in
Section 1 above shall be subject to all the conditions, restrictions and limitations as made and provided
for in Ordinance' Number 8526, the same being Chapter 42 of the Salina Code with reference to the
PLANNED DEVELOPMENT DISTRICT. Development of the property shall be subject to the plans on
file with the City Planning Commission and/or City Clerk and the following conditions, to -wit:
A. That the only uses permitted on said property shall be as follows:
(1) Apparel Stores;
(2) Banks and Financial Institutions;
(3) Barber and Beauty Shops;
(4) Business and Professional Offices;
(5) Dry Cleaning and Laundry Receiving (no processing);
(6) Foodstores (Grocery, Meat, Bakery, Delicatessens);
(7) Gasoline (self-service);
(8) Gift, Variety & Florist;
(9) Hardware;
(10) Package Liquor;
(11) Pharmacy;
(12) Restaurants and Private Clubs; and
(13) Photography'Studios.
B. That said property be developed in accordance with the approved
preliminary development plan of said PLANNED DEVELOPMENT
DISTRICT.
C. Development on Lot 9, Block 1 shall be subject to the C-2
(Neighborhood Commercial) bulk regulation, use limitations and sign
regulations.
D. A final development plan for Lot 9, Block 1 must be reviewed and
approved by the Planning Commission prior to issuance of a building
.permit.
Section 3. AMENDMENT. DISTRICT "PDD (R-2)". PLANNED DEVELOPMENT
DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as
a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby
amended so that the following described property be rezoned as follows, to -wit:

Lot One (1) thru Eight (8) and Ten (10) thru Thirteen (13), Block One (1) and Lots One
(1) thru Three (3), Block Two (2) in the Georgetown Villas Addition to the City of
Salina, Saline County, Kansas (formerly a part of Tract #3 of the Georgetown Village
Place PDD).
shall become a part of District "PDD (R-2)". PLANNED DEVELOPMENT DISTRICT.
Section 4. CONDITIONS OF APPROVAL. That the use of said described property in
Section 3 above shall be subject to all the conditions, restrictions and limitations as made and provided
for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "R-
2", MULTIPLE FAMILY RESIDENTIAL DISTRICT and the following conditions, to -wit:
1. Development limitations in the townhome area shall be as follows:
a) Development on Lots 1-8 and 10-13, Block 1 and Lots 1-3, Block 2 shall be
limited to fifteen (15) single-family attached dwellings containing no more than
two (2) units per building.
b) Each two family residential building shall be constructed as an attached
townhome designed for individual owner occupancy with separate utility service
to each unit and internal common firewall separation.
C) Development on Lots 1=8 and 10-13 and Lots 1-3, Block 2 shall be subject to the
lots size and bulk regulations of the R-2 (Multi -Family Residential) district,
except that:
1. The minimum lot depth shall be reduced from 100 ft. to 85 ft.
2. The minimum front yard setback shall be reduced from 25 ft. to 20 ft.
3. The minimum rear yard setback shall be reduced from 25 ft. to 15 ft.
4. The allowable lot coverage shall not exceed 40%.
d) The building footprint of each two-family residential building, including
attached garages, shall not exceed 1,200 sq. ft. No covered patios or porches
shall be permitted in -the side or rear yard areas.
2. Development of the townhome area shall be substantially conform to the approved
site development plan and.building elevations, and the driveway plan submitted by
the applicant's engineer which shall be incorporated as part of the approved final
development plan.
3. Landscaping shall consist of one (1) street tree for each individual dwelling unit
selected from the city's approved tree list and planted by the builder and other
plantings selected and planted by the owner.
Section 5. That Ordinance Number 93-9572 as it relates to the above described property is
hereby repealed.
Section 6. That this.ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
