08-08-2005 MinutesCommission Action # 1 L' 1 05-67981 CITY OF SALINA, KANSAS REGULAR MEETING OF THE BOARD OF COMMISSIONERS August 8, 2005 4:00 p.m. The City Commission convened. at 3:30 p.m. in a Study Session for a. Citizens' Open Forum. The Regular Meeting of the Board of Commissioners was called to order at 4:00 p.m. in Room 107, City - County Building. A roll call was taken followed by the Pledge of Allegiance and a moment of silence. There were present: Vice -Mayor Donnie D. Marrs, Chairman presiding Commissioner Alan E. Jilka Commissioner. R. Abner Perney Commissioner John K. Vanier H comprising a quorum of the Board, also present: Jason A. Gage, City Manager Greg Bengtson, City Attorney Penny Day, Deputy City Clerk Absent: Mayor Deborah P. Divine CITIZEN FORUM Craig King, King Industries, expressed his concerns about the status of the water line project on West Grand Avenue. Shawn O'Leary, Director of Public Works, responded to Mr. King's concerns, and Vice -Mayor Marrs informed Mr. King that City staff would contact him with the status of the project. AWARDS PROCLAMATIONS (4.1) The week of August 7 —13, 2005 as "National Health Center Week" in the City of Salina. Marcia Hawkes, CEO of Salina Health Education Foundation, read the proclamation and announced upcoming events. PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME None. CONSENT AGENDA (6.1) Approve the minutes of August 1, 2005. . Moved by Commissioner Jilka, seconded by Commissioner Perney, to approve the consent agenda as presented. Aye: (4). Nay: (0). Motion carried. DEVELOPMENT BUSINESS (7.1) Application #A05-4, filed by Frank Norton, requesting annexation of a 51.77 acre site located on the Northwest corner of Holmes. Road and Magnolia Road. (7.1a) First reading Ordinance No. 05-10299. Dean Andrew, Director of Planning and Community Development, explained the request, the impact on the water and sewer system in the area,. and the Planning Commission's recommendation. Mr. Andrew then responded to Commissioner Perney's questions concerning the homestead located next to this annexation property. Shawn O'Leary, Director of Public Works, addressed Commissioner Marrs' question concerning the maintenance of Holmes Road. Mr. Andrew explained the right-of-way issues on Holmes Road. (7.2) Application #Z05-4, filed by Kelly Dunn, requesting a change in zoning district classification from A-1(Agricultural) to R-1(Single-Family Residential) on a 40.32 acre tract of land r located on the east side of Markley Road north of Magnolia Road. Z W (7.2a) First reading Ordinance No. 05-10298. 760 Dean Andrew, Director of Planning and Community Development, explained.the location of the property to be rezoned and the purpose of the change in zoning, the elevation changes in the property, and the utilities situation. Mr. Andrew also explained that the second reading of this ordinance will be postponed until the property has been platted. Mr. Andrew responded to Commissioner Perney's question regarding the maintenance of Markley Road, and to Commissioner Vanier's question concerning the detention pond and the effects on future development. Shawn O'Leary, Director of Public Works, explained the controlled release of the detention pond and the location of the drainage. 05-6800 Moved by Commissioner Jilka, seconded by Commissioner Perney, to pass Ordinance No. 05-10298 on first reading. (7.3) Application #Z05-7, filed by Salina Regional Health Center, requesting a change in zoning district classification from R-3 (Multi -Family Residential) to H -M (Hospital— Medical). (7.3a) First reading Ordinance No. 05-10301. Dean Andrew, Director of Planning and Community Development, explained the zoning change and the increased flexibility that it will allow Salina Regional Health Center to have. He also noted that it would be consistent with the land use plan. 05-6801 Moved by Commissioner Perney, seconded by Commissioner Jilka, to pass Ordinance No. 05-10301 on first reading. Aye: (4). Nay: (0). Motion carried. (7.4) Application #Z05-6, filed by Landmark Development, requesting the rezoning of all of the lots in Woodland Hills Estates Addition No. 2 from R (Single=Family Residential) to R-1 (Single - Family Residential). (7.4a) First reading Ordinance No. 05-10300. Dean Andrew, Director of Planning and Community Development, explained the differences in the two types of zoning, the setback regulations, and the Planning Commission's recommendation. Mr. Andrew then responded to Commissioner Marrs' question concerning how long the current covenants would be in effect. OS -6802 Moved by Commissioner Vanier, seconded by Commissioner Pemey, to pass Ordinance No. 05-10300 on first reading. Aye: (4). ,Nay: (0). Motion carried. ADMINISTRATION (8.1) Second reading Ordinance No. 05-10296 levying special assessments to pay the cost of abatement of nuisances. Jason Gage, City Manager, clarified that no comments had been received since first reading of the ordinance on August 1, 2005. Mr. Gage then responded to Commissioner Vanier's question concerning the rates of the abatements. Dean Andrew, Director of Planning and Community Development, responded to Vice - Mayor Marrs' question regarding the notice given to the property owners. Further discussion continued between Mr. Gage, Mr. Andrew, Shawn O'Leary, and Vice - Mayor Marrs, and Commissioner Vanier regarding the rate structure, administrative fees, and the demolition process. (8.2) Second reading Ordinance No. 05-10297 annexing City owned property located on the south side of Magnolia Road (future Salina Soccer Complex site). Dean Andrew, Director of Planning and Community Development, reported that Ordinance No. 05-10297 was passed on first reading on .August 1, 2005 and since that time no comments have been received, however the commission could see a future item that would clarifying the boundary line. Moved by Commissioner Vanier, seconded by Commissioner Jilka, to adopt Ordinance No. 05-10297 on second reading. A roll call was taken. Aye: (4) Jilka, Perney, Vanier, Marrs. Nay: (0). Motion carried: (8.3) Resolution No. 05-6201 authorizing an Interlocal Solid Waste Disposal Agreement with McPherson Area Solid Waste Utility. Mike Fraser, Director of General Services, explained the agreement, and the history of the similar agreements that the City of Salina has with other counties. Mr. Fraser then responded to Commissioner Perney's question regarding minimum charges. Jason Gage, City Manager, responded to Commissioner Perney's questions concerning .the rates in McPherson County. Vice -Mayor Marrs stated that he appreciated the additional information that was provided on this item. A discussion followed regarding marketing the space that is available according to the report from Camp Dresser & McKee and the effects of raising the rates that we charge at the landfill. Shawn O'Leary, Director of Public Works, and Rodney Franz, Director of Finance and Administration, responded to Commissioner Vanier's question regarding the impact fee that is paid to Saline County. Moved by Commissioner Vanier, seconded by Commissioner Jilka, to approve Resolution No. 05-6201. Aye: (4). Nay: (0). Motion carried.
