08-10456 Zone Park West Addition(Published in The Salina Journal August -, 2008) ORDINANCE NUMBER 08-10456 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE Z PROPER USES THEREOF. Ca WHEREAS, all conditions precedent -for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described have been timely complied with, SO NOW, THEREFORE, 0 U BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -3". PLANNED SHOPPING CENTER. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: The West Fifty feet (W 50') of Lot One (1) and all of Lots Two ° (2) and Three (3) and Lot Eight (8) and the West fifty feet (W 50') of the North Two Hundred Seventy -Five and Eighty -Seven hundredths feet (N 275.87') of Lot Nine (9), together with the South half (S 1/2) of vacated Avalon Drive adjacent thereto, all in Block C, of the Park West Addition to the City of Salina, Saline County, Kansas addressed as 1320 Armory Road. shall become a part of District "PC -3". PLANNED SHOPPING CENTER. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the C-3 SHOPPING CENTER DISTRICT, except that limited outdoor storage shall be permitted as outlined in Condition 1. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: 1. Development and use of the property shall be limited to the uses permitted in the C-3 (Shopping Center) district and shall be subject to the bulk, use and sign limitations of the C-3 district with the exception that outdoor storage areas containing up to 4,200 sq. ft. in total area may be located on the east and south sides of the building. Outdoor storage areas shall be enclosed by black powder -coated chain link fencing up to 8 ft. in height. 2. Redevelopment of the property shall substantially conform to the approved site development plan and associated submittals which are herein incorporated by reference. No additions or modifications to the existing building footprint or any building demolition shall occur on the site without the review and approval of a site development plan amendment by the Planning Commission.
