08-6551 Build Over Utility Easement Variance1 1 RESOLUTION NUMBER 08-6551 A RESOLUTION AUTHORIZING A VARIANCE OF CITY ORDINANCE NO. 91- 486 TO ALLOW CONSTRUCTION OF A BUILDING OVER AN EXISTING UTILITY Z ASEMENT. IL w m c BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That a variance of City Ordinance No. 91-9486 is hereby approved to allow lonstruction of a Sonic Drive In restaurant over an existing public utility easement at 310 South Santa based on the following findings: A. Maintaining the existing 12 inch sewer line in the current alignment is the best means of maintaining public sewer service to the Masonic Temple. There is no feasible alternative for relocating the sewer line. B. The building construction proposed by Sonic Drive -In would cover only 24 ft. to 30 ft. of the existing sewer line. C. Sonic Drive -In has agreed to design and install a protective sleeve over the sanitary, sewer in accordance with specifications established by the Utilities Director. Section 2. That the existing sanitary sewer line located in the easement shall be encased, the expense of DL Rogers Corporation in accordance with specifications determined by the Utilities Section 3. That this resolution shall.be in full force and effect from and after its adoption.
