ORDINANCE NO. 08-10441
AN ORDINANCE OF THE GOVERNING BODY OF THE CITY OF SALINA,
w KANSAS MAKING FINDINGS AND ADOPTING A REDEVELOPMENT
PROJECT PLAN PURSUANT TO K.S.A. 12-1770 ET SEQ., AND AMENDMENTS
THERETO.
A
WHEREAS, pursuant to the provisions of K.S.A. 12-1770 et seq., as amended (the "Act"), the City
of Salina, Kansas (the "City") is authorized to establish redevelopment districts within a defined area of the
City which was found by Resolution No. 07-6446 adopted by the governing body of the City on December
10, 2007 to be a blighted area, and is therefore an "eligible area" as said term is defined in the Act; and
WHEREAS, the Governing Body adopted Resolution No. 07-6447 on November 5, 2007 calling for
a public hearing considering the establishment of a redevelopment district to be held by the Governing Body
on December 10, 2007; and
WHEREAS, notice of the public hearing on establishment of a redevelopment district was given as
required by the Act; and
WHEREAS, a public hearing on establishment of a redevelopment district was held on December
10, 2007 and closed on the same day; and
WHEREAS, the City, by the adoption of Ordinance No. 07-10428 on December 10, 2007, created a
redevelopment district (the "Redevelopment District") consisting of a single redevelopment project area, the
boundaries of which are contiguous with the boundaries of the Redevelopment District (the "Project Area");
and ,
WHEREAS, the City is considering the adoption of a redevelopment project plan entitled "City of
Salina Lambertz Addition Redevelopment District Tax Increment Financing Redevelopment Project Plan" and
dated January 8, 2008, as amended by the amended redevelopment project plan entitled "AMENDED City of
' Salina Lambertz Addition Redevelopment District Tax Increment Financing Redevelopment Project Plan" and
dated March 5, 2008 (the "Project Plan") which provides for the redevelopment of the Project Area within the
Redevelopment District; and
WHEREAS, on January 15, 2008,the Planning Commission of the City made a finding that the
Project Plan is consistent with the intent of the City's comprehensive plan for the development of the City;
and
WHEREAS, a copy of the Project Plan, and all amendments thereto, was delivered by the City to
the Board of County Commissioners of Saline County and to the Board of Education of Unified School
District No. 305; and
WHEREAS, the Governing Body adopted Resolution No. 08-6478 on January 17, 2008 calling for a
public hearing considering the adoption of the Project Plan to be held by the Governing Body on February
25, 2008; and
WHEREAS, notice of a public hearing on adoption of the Project Plan was given as required by the
Act; and
WHEREAS, a public hearing on adoption of the Project Plan was opened on February 25, 2008,
continued to March 10, 2008, and closed on March 10, 2008.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
' SALINA, KANSAS:
Section 1. The Governing Body hereby adopts the Project Plan, which governs redevelopment
of the real property in the Project Area, which is shown on Exhibit A and legally described as follows:
Lot One (1), Block One (1), Lambertz Addition to the City of Salina, Saline County, Kansas.
Section 2. The Act authorizes the issuance of bonds by the City to finance all or a portion of
the costs of implementing the Project Plan. Said bonds may be issued to reimburse expenditures made on or
after the date which is 60 days before the date of passage of this Ordinance, pursuant to Treasury Regulation
§ 1.150-2.
Section 3. The City may issue its full faith and credit tax increment bonds to finance the costs of
implementing the Project Plan, unless within 60 days following the date of the closure of the public hearing
on the Project Plan a protest petition signed by 3% of the qualified voters of the City is filed with the City
Clerk in accordance with the provisions of K.S.A. 25-3601 et seq., and amendments thereto. If a sufficient
petition is filed, no full faith and credit tax increment bonds shall be issued until the issuance of the bonds is
approved by a majority of the voters voting at an election thereon. Such election shall be called and held in the
manner provided by the general bond law. The failure of the voters to approve the issuance of full faith and
credit tax increment bonds shall not prevent the City from issuing special obligation bonds in accordance with
the Act.
Section 4. This Ordinance shall take effect and be in force from and after its passage by a 2/3
vote of the governing body, and its publication once in the official City newspaper.
