ORDINANCE NUMBER 02-10078
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE
DRAINAGE AND UTILITY EASEMENT LOCATED BETWEEN LOTS 5 AND 6, BLOCK 1,
REPLAT OF EASTBANK ESTATES ADDITION TO THE CITY OF SALINA, SALINE
COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on April 22, 2002, the governing body conducted a public hearing on the
petition of Lawrence Curran ("Petitioner") requesting vacation of a portion of the drainage and utility
easement located between Lots 5 and 6, Block 1, Replat of Eastbank Estates Addition in the City of
Salina, Saline County, Kansas, more particularly described as follows and shown on Exhibit "A":
hearing that:
Beginning at a point which is thirty-five (35) feet southwest of the southeast
corner of Lot Five (5); Thence southwesterly along the line common to said
Lots Five (5) and Six (6), a distance of One hundred twenty-one and twenty
hundredths (121.20) feet to the easterly side of the twenty (20) foot drainage
and utility easement along the westerly side of said Lots Five (5) and Six (6).
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the
drainage utility easement.
(c) Injustice to the Petitioner vacation of the drainage and utility easement
should be granted.
Section 3. Said easement is hereby vacated and shall revert back to the
owners of Lots 5 and 6, Block 1, Replat of Eastbank Estates Addition in accordance with
K.S.A 13-443.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
