ORDINANCE NUMBER 07-10418
AN ORDINANCE PROVIDING FOR THE VACATION OF THE NORTH FIFTEEN
(15) FEET OF AN EXISTING THIRTY-FIVE (35) FOOT UTILITY EASEMENT ALONG
THE SOUTH LINE OF LOT ELEVEN (11) AND THE EAST FIVE (5) FEET OF LOT
TWELVE (12), BLOCK ONE (1) IN THE CEDAR RIDGE ADDITION TO THE CITY OF
SALINA, SALINE COUNTY, KANSAS.
BE ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on October 1, 2007 and October 15, 2007, the governing body conducted a
public hearing on the petition filed by Bob Haworth, President of Lee Haworth Construction
Company, ("Petitioner") requesting vacation of the North Fifteen (15) feet of an existing Thirty-five
(35) foot utility easement along the south line of Lot Eleven (11) and the East Five (5) feet of Lot
Twelve (12), Block One (1) in the Cedar Ridge Addition.
that:
Section 2. That the governing body finds from the evidence presented at the public hearing
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by the vacation of a portion of the utility
easement.
(c) In justice to the Petitioner the easement vacation request should be granted.
Section 3. That the North fifteen (15) feet of the existing thirty-five (35) foot utility
easement along the south line of Lot Eleven (11) and the East five feet of Lot Twelve (12), Block
One (1) in the Cedar Ridge Addition is hereby vacated.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
