AN ORDINANCE Providing for the paving and curbing of Iron Avenue in
the City of Salina, Kansas, between the west end of Iron Avenue bridge
and the east side of Santa Fe Avenu-, and between the west side of Santa
Fe Avenue ana the east line of College Avenue in said City; specifying the
material to be used and the manner of construction; and providing for the
cost thereof and the manner of payment.
WHEREAS by resolution duly adopted on the 16th day of November 1906,
the Mayor and Council of the City of Salina have declared that they deem
it necessary to pave and curb Iron Avenue between the limits above set forth, I
and
WHEREAS the said resolution was duly published for ten (101 conseefti-e
days in the Salina Evening Journal, a daily newspaper published in said
City , and

WFiEREUS more than twenty (20) days have elapsed since the said publica-
tion was completed and no protest has been filed agAinst the said proposed
provements on Iron Avenue by resident property owners subject to taxation
therefor, ard-

a GERAS the City of Salina, Kansas, is a city of the second class with
less than Ten Thousand (10,000) inhabitants, therefore
BE IT OEDAINED by the Mayor and Council of the City of Salina,
Section 1. That it is necessary and hereby ordered that Iron
Avenue in the City of Salina, Kansas, between the west end of Iron Avenue
bridge across the Smoky Hill River and Vile east line ofSanta Fe Avenue

and between the west line of Santa Fe Avenue and the -11#:Gt line of College
Avenue in said city be paved with brick pavenrent ; said pa7;,irp, between the
west end of Iron Avenue bridge across the Smoky Hill River, and the east line
.of Santa Fe Avenue and between the Ojest line of Santa Fe Avenue and the
west line af Ninth Street to be Sixty seven (67) feet in width, or from
curb to curb, and from the west line of ninth Street to the east line of
College Avenue, said pa-7iro- to be Forty two (42) feet in width in the center
of the street, except at the ct-ossings of the streets, avenues and alleys
where said pavenent shal-1 be One Hundred (100) feet in width or from lot
line to lot line; whi,--h said pavement aLf-oresaid shall in all respects be in
accordance with the --rj',vns and specifications of tu--Le City Engineer, filed
in the City Clerk's office on the 26th day of February 1907.
Sectio -d. that it is necessary and hereby oranered that Iron

Avenue in the City of Salina, within the limits above set forth Ye curbed
on both sides thereof according to said plans and specifications, and that
between the west end of said Iron Avenue bridge and. the east line of Santa
Fe Avenue and the west line of Santa Fe Avenue and the east line of Ninth
Street, said curbing shall be set Sixteen and one half (16 1/2) feet from
and parallel with the lot lines on both sides of said street, and between
the west line of Ninth Street and the east line of College Avenue s7add
curbing shall be set twenty one (21) feet from the center of said street on
each side of the center thereof, excepting at the intersections of streets
and alleys -,,,,,here said curb shall be constructed so as to form a connection
with the right curbing on Santa Fe Avenue and upon other streets and alleys
shall return.,to the 'Lot lines of such other streets and alleys.
Section 3. That all excavating, filling; and rolling necessary for
the proper construct ion of said paving and curbing shall be done.
Section 4. That all said paving, curbing, excavating and rolling
shall be done in accordance with the plans, specifications and profiles o'['
plass,
the City Engineer of said City now on file in the office of the City Clerk
of said City ,said paving to be of Coffey Ville Paving Blocks at the
price of $1.78 per square yard,that the excavation shall be done and per
formed at the price of 32 and 1/2 cents per cubic yard land that the Cemet
Cement curbing shall be done and finished at the price of
5-5 1/2 cents for six inch curbing and 45,1/2 cents for five inch curbing
xwum as specified in the bid of Haskins and Ramsey, mated xad filed
in the City Clerks office on March 13th 1907,which bid is her eby
specifically referred to and made a part of this Ordinance
Section 5. That, after the passage and publication of this ordinance the
Idayor and councilmen shall agpoint three disinterested householders, who,
after having taken an oath faithfully and -impartially appraise all the lots
and parcels of ground liable to taxation for the improvement, shall within
ten days after being notified of their appointment proceed to appraise said
lots and parvels of ground liable to taxation (without regard to any building
or improvements located thereon) and after making said appraisement shall
return the same to the �Iity Council at the first meeting thereof after such
appraisement shall have been completed and after said appraisement is returne
to the City Council, the Mayor and Council shall designate a time for holding
a special session for the puypose of hearing complaint and equali,,,-,ing said
appraisement of Which special session due notice shall be given in the official
City paper and at said special session the Mayor and Council shall, if the7
deem it just.and proper, alter or change said appraisement.
Section 6. After the publication of this ordinance has been made accord
ing to law, the Mayor and City Clerk of said cit* hereby authorized and
directed to make and enter a proper and suitable contract for the work to be
done under this ordinance not excee6ing the estimated cost heretofore made
the City Engineer for the paving, curbing, excavating, filling, and rolling
provided for herein and not exceeding the prices named in t�bYrd_accepted bysaid council and to execute the same on behalf of said city wit"4-0�
a f)roviding that all work to be performed under said contract steal
be performed in accirdance with the provisions of this ordinance.
Section 7. For the purpose of paying for said paving, curbing, excava-
ting, etc., the Mayor and City Council are hereby authorized and (firected to
issue bonds of the City of Salina in amount not to exceed the contract price
and to run for a period of ten years and be payable in ten equal annual in-
stallments, one-tenth (1/10) in one year, one-tenth (1/10) in two years and
6ne-tenth (1/10) each year thereafter Intil the same shall be fully paid
together with interest not to exceed five (5%) per cent per annum; which bond
shall be payable at the Fiscal Agency of the State of Kansas at New York City.
And for the purpose of paying principal and interest on said bond as they
severally become due, the Ilayor and Council shall each year during the life
of the bonds levy an assessment against the lots ard. parvels of ground liable
to taxation for the improvement and amount sufficinet to pay the principal
and interest for that ,rear. Provided that for tille purpose of defraying the

intersections of streets and alleys the assessment shall be made against the
all the taxabel property in the city; and the City Clerk shall certify said
assessments as they are severally made to the County Clerk, Saline County,
city
at the same time and in the same manner as other taxes are certified ard said
assessments shall be liable to the same penalties as all other taxes.
Section 8. This ordinance shall take effect and be in force from and
after its publication once in the Salina Evening Journal.
