1295 Prevention of ExcavationORDINANCE No An Ordinance preventing excavations in the streets, alleys and other public grounds of the City of Salina, except as here - ,in provided, and providing a penalty therefor, and repealing Section 329 of Ordinance 635. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it shall be unlawful for any person or persons, firm or corporation, under any permit, franchise, right or pretense, to make or cause to be made, any excavation in any street* alley or public grounds in said City for the purpose of putting in or repairing any water or gas pipet or for any other purpose whatever$ excepting as hereinafter provided. Section 2. Any one desiring to make any excavation in any street, alley or public grounds in said City for any purpose whatever, shall first secure from the Clerk of said kity, a permit, authorising him or them or said corporation or firm to do so. 'Each -permit shall state IV, specificly, the boundries within which said excavation is to be made and providing further, that the person or corporation or firm so applying for said permit, shall, in case of a paved street or alley or other public grounds,, deposit with the said Clerk of the said City of Salina, Three Dollars ($3.00) for each cubic yard of excavation to be made, provided that the total amount of money so deposited for excavating in a paved street, alley or other public paved grounds, shall in no case be less than Fifteen Dollars ($15.00) nor more than P,04D011ars. And in case of an unpaved street, or alley or other public unpaved permit grounds, such person, corporation or firm so applying for such pe it shall deposit with the City Clerk of said City of Salina.10c for each cubic yard of excavation to be made, provided that said total amount of money so deposited for excavation in an unpaved street, alley or other public grounds, shall in no case be less thanandmann Dollars ("J5.00) nor more than Dollars. And that the money so deposited shall remain in the hands of said Clerk until ,such time as the City Engineer of the City of Salina shah, file in the office of the said Clerk of the said City, his written ap- proval shoring that the paving has been properly repaired in the case of a paved street and that the said excavati A� s en refilled, and tamp- ed and repacked thoroughly so that said refilled excavation and paving shall conform with the grade of the street at that point, at which time the balance of the said deposit in excess of the cost of repairing, refilling, and t/amping said excavations and pavings, shall be returned to the person so depositing the sane. Any one vjc lating any of the previsions of this Ordinance may be fined in any sum not exceeding One Hundred �l ( Dollars ($100.00). i Section 4. Section 32 of Ordinance #635 of the Published Ordinance of said City is hereby repealed. I Section 5.
