07-10407 Municipal Court Jurisdiction(Published in the Salina Journal on August 10 2007) ORDINANCE NUMBER 07-10407 AN ORDINANCE AMENDING CHAPTER 23, ARTICLE I, OF THE SALINA CODE BY ADDING SECTION 23-2 PERTAINING TO GIVING MUNICIPAL COURT JURISDICTION TO HEAR DUI, DOMESTIC BATTERY AND THEFT CASES THAT COULD BE THIRD OR SUBSEQUENT OFFENSES. a w BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: A Section 1. That the Salina Code is hereby amended by adding a section to be numbered, Section 23-2, which section reads as follows: U "Sec. 23-2. Jurisdiction. The Municipal Court shall have jurisdiction to hear and determine cases involving violations of the ordinances of this city, including jurisdiction to hear and determine a violation of an ordinance when the elements of such ordinance violation are the same as the elements of a violation of one of the following state statutes and would constitute, and be punished as a felony if charged in the district court: K.S.A. 8-1567, and amendments thereto, driving under the influence; K.S.A. 21-3412a, and amendments thereto, domestic battery; or K.S.A.21-3701, and amendments thereto, theft." Section 2. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
