CHARTER ORDINANCE NO. 29
A CHARTER ORDINANCE EXEMPTING THE CITY OF SALINA, KANSAS, FROM
THE PROVISIONS OF K.S.A. 13-1024a AND PROVIDING SUBSTITUTE AND
ADDITIONAL pROVISIONS ON THE SAME SUBJECT RELATING TO GENERAL
IMPROVEMENTS AND THE ISSUANCE OF BONDS FOR THE PURPOSE OF PAYING
FOR SAID IMPROVEMENTS GENERALLY, AND AN ANIMAL SHELTER
SPECIFICALLY.
BE IT ORDAINED by the governing body of the City of Salina, Kansas:
Section 1. Election to Exempt. The City of Salina, Kansas (the "City") by virtue of the
powers vested in ia by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects
to exempt itself fiom and hereby make inapplicable to it Section 13-1024a, Kansas Statutes Annotated,
that applies to the ~ity, but is part of an enactment which does not apply uniformly to all cities, and
thereby provides s~tbstitute and additional provisions on the same subject as hereinafter provided.
Section 2. iSubstitute and Additional Provisions. The City of Salina, Kansas hereby adopts
the following substitute and additional provisions for Section 13-1024a, Kansas Statutes Annotated:
For the purpose of paying for any bridge, viaduct, public building, including the land
necessary therefor, for lands for public parks and developing the same, within or
without thei city, for the establishment and construction of crematories, desiccating or
reduction Works, including the land necessary therefor, within or without the city, or
for the improvement, repair or extension of any waterworks, sewage disposal plant,
electric light plant, crematory, desiccating or reduction works or other public utility
plant owned by the city, and for the purpose of rebuilding, adding to or extending to the
same fi:om time to time, as the necessities of the city may require, the city may borrow
money and~ issue its bonds for the same: Provided, That no bonds shall be issued for
such purpoges unless the same were authorized by a majority of the votes cast at an
election held for that purpose: Provided further, That the city may issue the bonds of
the city for/he purpose of paying for any of the improvements mentioned in this section
and the land necessary therefor without such bonds having been authorized by a vote
of the people, but the total amount of bonds issued for an animal shelter facility shall
not exceed the sum of nine hundred thousand dollars ($900,000) and for any other such
purposes shall not exceed the sum of two hundred fifty thousand dollars ($250,000),
in any one year.
Section 3. Repealer. That Charter Ordinance Number 13 of the City of Salina, Kansas, is
hereby repealed.
Section 4. '~Publication of Ordinance. This Charter Ordinance shall be published once each
week for two consecutive weeks in the official City newspaper.
Section .5.. t~ffective Date. This Charter Ordinance shall take effect sixty-one (61) days after
final publication unless a sufficient petition for a referendum is filed requiring a referendum to be held
on this ordinance aS provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the
State of Kansas, in Which case the ordinance shall become effective if approved by a majority of the
electors voting thereon.
PASSED bY the governing body, not less than two-thirds of the members elect voting in favor
thereof, this 18th day of May, 1998.
