23 General Improvement BondsKuh.-Cox P~inting -- Salina, Kansas [First Published in The Salina Journal August~~¥, ~/~'/~""~'~'1988) CHARTER ORDINANCE NUMBER 23 A ClflARTER ORDINANCE EXEMPTING THE CITY OF SALINA, KANSAS, FRO~ THE PROVISIONS OF K.S.A. 13-1024a AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME WHICH RELATE TO GENERAL AND THE ISSUANCE OF BONDS FOR THE PURPOSE IMPROVEMENTS OF PAYING FOR SAID IMPROVEMENTS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Sectio,n 1. Election to exempt. That the City of Salina, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 13-1024a and provide substitQte and additional provisions as hereinafter set forth in this ordinance. SuCh referenced provisions are either enactments or a part thereof which are appliCable to this city that are not applicable uniformly to all cities. Sectio9 2. Substitute and additional provisions. That the City of Salina, does hereby provide substitute and additional provisions on the same subject as follows, to wit: "13-1024a. General improvements and land therefor; borrowing money and bOnd issues; when election required. For the purpose of paying for any bridge, viaduct, public buildings, including the land necessary therefor, for lands for public parks and developing the same, iwithin or without the city, for the establishment and constraction of crematories, desiccating or reduction work, includiPg the land necessary therefor, within or without the city, {)r for the improvement, repair or extension of any waterw~orks, sewage disposal plant, electric light plant, crematory, desiccating or reduction work or other public utility i plant owned by the city, and for the purpose of rebuilding, adding to or extending the same from time to time, as the necessities of the city may require, the city may I~orrow money and issue its bonds for the same; Provided, that no bonds shall be issued for such purposes unless ithe same were authorized by a majority of the votes cast atj an election held for that purpose; Provided further, that any city of the first class may issue bonds of such city for the purpose of paying for any of the improvements mentioned in this section and the land necessary therefor without~ such bonds having been authorized by a vote of the people,;~ but the total amount of bonds issued for such purposes shall not exceed the sum of seven hundred fifty thousand dollars ($750,000) in any one year." Kubn-Cox Printing -- Salina, Kan~s Sectio.~ 3. Repealer. That Charter Ordinance Number 13 of the City of Salina, Kansas, be and the same is hereby repealed. Sectio~ 4. Publication of ordinance. This Charter Ordinance shall be published once a week for two (2) consecutive weeks in The Salina Journal, the official city newspaper. Section 5. Effective date. This iS a Charter Ordinance and shall take effect sixty-one (61) days after final publication, unless a sufficient petition for referendum is filed and the referendum held on the ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the State of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.
