14 Public Alcohol Consumption ~MAKIER ORDINANCE NUMBER 14 (_First Pub!!shed in The Sa!ina Jo,rna! ~mm_-~m ~ ~ /~ ~ . ~//~ A CHARTER ORDINANCE EXEMPTING THE CITY OF SALINA, KANSAS FROM THE PROVISIONS OF K.S.A. 41-719 AND PROVIqlNG SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME WHICH RELATE TO THE CONSUMPTION OF ALCOHOLIC LIQUOR IN PUBLIC PLACES. BE IT ORDAINE~ by the Governing Body of the City of Salina, Kansas: Section 1. Tk~t the City of Saiina, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 41-719 and provide substitute and additional provision~ as hereinafter set forth in this ordinance. Such referenced provisions are either enactments or a part thereof which are applicable to this City that are not applicable uniformly to all cities. Section 2. Tha the City of Salina does hereby provide substitute and additional provisions on the same su ject as follows, to-wit: "4]-7'9. It shall be unlawful for any p~rson to Orink or consume alcoholic liquor upon the public streets, alleys, roads or highways, or in beer parlors, taverns, pool halls or places o which the general public has access, whether or not an admissi, n or other fee is charged or collected, or upon property owned by t .~ state or any governmental subdivision thereof or inside vehicles wh|le upon the public streets, alleys, roads or highways; i~o~¢~, /~,~e~e~, The limitations, aforesaid, shall not app]y to real proper~y leased by a city to others under the provisions of K.S.A. 12-1 '40 to 12-1749, both sections inclusive, and any amendments thereto, if such real property is actually being used for hotel or motel purpo.,.es or purposes incidental thereto, nor shall said limitations apply to any state owned or operated building or structure arid the surrounding premises which are furnished to and occupie( by any state officer or employee as a residence; ~DmO~OTeOT ~'~z~¢Z,, That by ordinance, any city having a population of more than thirty thousand (30,000) may by ordinance exempt certain property, title of which is vested in such city, from the provisions of this act. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor, and upon conviction s lall be punished by a fine of not less than fifty dollars ($50) nor mo-e than two hundred dollars ($200), or by imprisonment for not more than six (6) months or be both so fined and imprisoned." Section 3. This (~harter Ordinance shall be published once a week for two consecutive weeks in The Salina Journal the official city newspaper. Section 4. This s a Charter Ordinance and shall take effect sixty-one (6l) days after final publicatio , unless a sufficient petition for referendum is filed and the referendum held on the ordinance is provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the State of Kansas, in which case the ordinance shall become :ffective if approved by a m.~jority of the electors voting thereon. Harrison, Cit~ Clerk The foregbing Charter Ordinance Number 14 was passed on the 3rd day of October, 1977, as shown by the Journal of proceedings Number 27, page 376, by a vote of five for and zero against, being not less than two-thirds of the members elect of the Governing Body,! published in the Salina Journal, the official city newspaper, on the 6th day of October, 1977 and on the 13th day of October, 1977, being once a week for two consecutivei weeks, and there being no petition demanding a referendum filed with the City Clerklwithin sixty days after the final publication, said Charter Ordinance took effect on the 13th day of December, 1977.
