A CHARTER ORDNANCE EXEMPTING THE CITY OF SALINA, KANSAS, FROM THE PROVISIONS OF
~K.S.A. 1973 SUPP. 16-70', WHICH PROVIDES FOR THE LICENSING OF PAWNBROKERS AND PROVIDING
SUBSTITUTE AND ADDITION~L PROVISIONS ON THE SAME SUBJECT AND REPEALING CHARTER ORDINANCE
NUMBER 11.
BE IT ORDAINEI by the Governing Body of the City of Salina, Kansas:
Section 1. T~at the City of Salina, Kansas, a City of the First Class, by the
powers vested in it by ,rticle 12, Chapter 5 of the Constitution of the State of Kansas,
hereby elects to and do ~s exempt itself from and makes inapplicable to it the provisions of
K.S.A. 1973 Supp. 16-70] and provides substitute and additional provisions on the same
subject, as follow to-wit:
"16-707. Licensing of pawnbrokers; ~ppl.ica.~i~n fee; disposition.
No person shall engage or continue in business as a pawnbroker
without first obtaining a license therefor. If his place of
business is inside the corporate limits of any city of the first
or second class% he shall obtain such license from the clerk of
such city, and if it is outside the corporate limits of any such city,
he shall obta n his license from the county clerk of the county in
which his pla~ e of business is located. Application for such license
shall be in wr ting and shall state the full name and place of
residence of t ~e applicant, or if the applicant be a partnership,
of each member thereof~ or, if a corporation or association, of each
officer,, share.~older or member thereof, together with the address of
the place or p aces where the business is to be conducted and the
hours of the d.~y and days of the week during which the applicant
proposes to en~age in the business of pawnbroking at each such place,
and such other information as may be necessary to determine the
applicant's qu.~lifications for a license in accordance with the
provisions of ~his act. Each applicant shall also submit with his
application: ( ) A statement that he is the holder of a valid
registration o,rtificate issued by the Director of Revenue pursuant
to K.S.A. 79-3~,08 for each place of business for which application
for license isimade; and (2) A detailed inventory and description
of all goods' ~,ares, merchandise or other property held in pawn or
for sale at th~ time of the application at each place of business
stated therein, indicating whether the same was received in pawn
or purchase as secondhand merchandise. Said application shall be
in a form appr~ved by the Attorney General. Each application
shall be accom,anied by a fee of not less than $25.00 nor more
than $300.O0,b'he~ exact amount of which shall be determined from
time to time 'an ordinance adopted by the governing body and such
fee shall be p.~id annually upon renewal of the license. All such
fees received y the city Clerk shall be deposited in the city
general fund, nd all such fees received by the county clerk shall
be deposited i the county general fund~"
Section 2. Th s ordinance shall be published once a week for two consecutive
weeks in The Salina Journal, the official city newspaper.
Section 3. That Charter Ordinance Number 11 is hereby repealed.
Section 4. This is a Charter Ordinance and shall take effect sixty-one (61) days
after final publication nless a sufficient petition is filed and a referendum held on the
ordinance as provided in ~rticle 12, Section 5, Subdivision (c) of the Constitution of
Kansas, in which case th~ ordinance shall become effective if approved by a majority of
the electors voting therean.
Adopted by the ~overning Body by not less than two-thirds of the members elect
voting in favor thereof aad approved by the Mayor this 12th day of May, 1975.
The foregoing Charter Ordinance Number 12 was passed on the
12th day of MaY, 1975, as shown by the Journa! of Proceedings Number 26,
Page 77, by a Vote of four for and zero against, being not less than
two-thirds of ~he members elect of the Governing Body, published in the
Salina Journal! the official~ city newspaper, on the 16th day of May, 1975,
and on the 23rd day of May, 1975, being once a week for two consecutive
weeks, and the~e being no petition demanding a referendum filed with
the City Clerkiwithin sixty days after the final publication, said
Charter Ordinance took effect on the 23rd day of July, 1975.
