11 License Pawn Brokers CHARTER ORDINANCE NUMBER 1 t (First Published in The Salina Journal ~~ I~~ , 1974) A CHARTER ORDI ANcE EXEMPTING THE CITY OF SALINA, KANSAS, FROM THE PROVISIONS OF K.S.A. 1973 SUPP. 16-707 WHICH PROVIDES FOR THE LICENSING OF PAWNBROKERS AND PROVIDING SUBSTITUTE AND ADDITIONA PROVISIONS ON THE SAME SUBJECT. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. Th it the City of Salina, Kansas, a City of the First Class by the powers vested in it by A]ticle 12, Chapter 5 of the Constitution of the State of Kansas, 'hereby elects to and does exempt itself from and makes inapplicable to it the provisions of --K.S.A. 1973 Supp. 16-707 /and provides substitute and additional provisions on the same / subject as roi lows, to-wi~: "16-707. .icensin§ of pawnbrokers; application feet disposition. No person shall engage or continue in business as a pawnbroker without first obtaining a license therefor. If his place of business is inside ~he corporate limits of any city of the first or second class, he ~hall obtain such license from the clerk of such city, and if it is o~tside the corporate limits of any such city, he shall obtain his license from the county clerk of the county in which his place of bJsiness is located. Application for such license shall be in writing and shall state the full name and place of residence of the applicant, or if the applicant be a partnership, of each member thereof, or, if a c.~rporation or association, of each officer, shareholder or member the-eof, together with the address of the place or places where the business is to be conducted and the hours of the day and days of the week daring which the applicant proposes to engage in the business of pawnbro<ing at each such place, and such other information as may be necessary to determine the applicant's qualifications for a license in accordance with the provisions of this act. Each applicant also shall - submit wit, his application: (1) A statement that he is the holder of a ~ valid regi ~tration certificate issued by the director of revenue pursuant to K.S.A. ~9-3608 for each place of business for which application for a -- license is made; and (2) a detailed inventory and description of all goods, wares, mer~'handise or other property held in pawn or for sale at the time of the app.ication at each place of business stated therein, including whether th~ same was received in pawn or purchased as secondhand merchandise. Said appli~:ation Shall be in a form approved by the attorney general. Each applicatio~ shall be accompanied by a fee of one hundred fifty dollars ($150.00) ~hich fee shall be paid annually upon renewal of the license. All such f&es received by the city clerk shall be deposited in the city fu~d, and all such fees received by the county clerk shall be general deposited ~n the county general fund." Section 2. Thi~ ordinance shall be published once a week for two consecutive weeks in The Salina Journ I, the official city newspaper. Section 3. Thi is a Charter Ordinance and shall take effect sixty-one (61) days after final publication u less a sufficient petition is fi led and a referendum held on the ordinance as provided in rticle 12, Section 5, Subdivision (c) of the Constitution of Kansas, in which case th~ ordinance shall become effective if approved by a majority of the electors voting thereon. Harrison, ~uiYy ulert< The foregoing Charter Ordinance Number 11 was passed on the 9th day of Dece~mber, 1974, as shown by the Journal of Proceedings Number 25, Page 288, by a vote of five for and zero against, being not less than two-tihirds of the members elect of the Governing Body, published in the Salina JOurnal, the official city newspaper on the 13th day of December, 1974, and on the 20th day of December, 1974, being once a week for two consecutive weeks, and there being no petition demanding a referendum fi led with the City Clerk within sixty days after the final publication, said Charter Ordinance took effect on the 19th day of February, 1975.
