09 Levy Taxes i CHARTER ORDINANCE NO. 9 (First Publishe~ in The Salina Journal ~x~ ~Z~1974.) A CHARTER ORDIN~NCE EXEMPTING THE CITY OF SALINA, KANSAS, FROM K.S.A. 79-1951, WHICH PROVIDES FOR A MAXIFOM RATE OF LEVY IN ANY ONE YEAR; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON tHE SAME SUBJECT; AMENDING CHARTER ORDINANCE NO. 3 OF THE CITY OF SALINA, KANSAS, AND REPEALING SAID EXISTING CHARTER ORDINANCE. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That Charter Ordinance No. 3 of the City of Salina, Kansas, is hereby amended to read as follow~: (1). That the City of Salina, a city of the first class, by the power vest~d in it by Article 12, Chapter 5 of the Constitution of the State Df Kansas, hereby elects to exempt and does exempt itself from and m~kes inapplicable to it K.S.A. 79-1951, which is not , applicable uniformly to all cities and to provide substitute and additional provisions of the same aubject. (2). That the governing body of the City of Salina is hereby authorized and empowered to levy taxes in each year on each dollar of assessed tangible valuation of said city and to set such rate of levy as may be needed to meet the requirements of its adopted budget for the following purposes: G~neral Operating Fund, which shall include the following activities: General government, police depart~nent; fire department; health and sanitation; waste disposal; streets, alleys and highways; maintenance of public buildings; swimming pool; parks; animal control; -- street lighting; traffic signals and parking control; civil defense; airport; judgements; band; cemetery; genera[ improvement (except ~mpNo~N~ments for which special assessnmnts are made); industrial fund; noxious weeds, tree m~intenance; and flood control. Provided thi~t the City purposes specifically authorized by other statutes are not excluded because they are not above enumerated; and provide~ further that the aggregate of all city wide tax levies of said cit~ is not limited, except as provided by legislative enactments ~niformly applicable to all cities. Section 2. Charter Ordinance No. 3 of the City of Salina, Kansas is hereby repealed. I Section 3. This ~rdinance shall be published once a week for two (2) ~onsecutive weeks in The S~lina Journal, the official city newspaper. Section 4. This ~s a Charter Ordinance and shall take effect sixty-one (61) days after final publicaticn, unless a sufficient petition for a referendum is filed and a referendum held on tie ordinance as provided in Article 12, Section 5, Subdivision (c) of the Constitution of Kansas in which case the ordinance shall become effective if approved by the majority of the electors voting thereon.
