A CHARTER ORDINANCE EXEMPTING THE CITY OF ~LINA, KANSAS, FROM THE PROVISIONS OF
K.S.A. 12-14a05, WHICH DE?INES A BAND FOR THE PURPOSES OF USE OF BAND FUNDS AND PROVIDING
SUBSTITUTE ANDADDITIONAL PROVISIONS ON THE SAME SUBJECT.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Tha~ the City of Salina, Kansas, a City of the First Class by the
powers vested in it by Arl:icle 12, Chapter 5 of the Constitution of the State of Kansas,
! aereby elects to and does exempt itself from and makes inapplicable to it the provisions
---of K.S.A. 12-14a05 and pr~ides substitute and additional provisions on the same subject
as follows, to wit:
"12-14a05. Definition of Band.
That the meaning of the word 'Band' as used in this act
shall be al~y musical group which in the opinion of the Governing
Body of tk~ City of Salina is capable of presenting worthwhile
and enterl ~ining band concerts or musical services."
Section 2. ordinance shall be published once a week for two consecutive
weeks in the Salina Journal, the official city newspaper.
Section 3. Thisiis a Charter Ordinance and shall take effect sixty-one (61) days
after final publication un~ess a sufficient petition is filed and a referendum held on the
ordinance as provided in A~ticle 12, Section 5, Subdivision (c) of the Constitution of
Kansas, in which case the ~rdinance shall become effective if approved by a majority of
~he .electors voting thereo~.
Adopted by the Gcverning Body by not less than two-thirds of the members elect
voting in favor thereof and approved by the Mayor this 29~ day of October, 1973.

The foregoi ~g Charter Ordinance Number 8 was passed on the 29th day of
November, 1973, as sh¢'~wn by the Journal of Proceedings, Number 24, Page 466, by a
vote of five for and ~ero against, being not less than two-thirds of the members-
elect of the Governin~ Body, published in the Salina Journal, the official city
newspaper on the 2nd day of November, 1973, and on the 9th day of November, 1973,
being once a week forltwo consecutive weeks, and there being no petition demanding
a referendum filed wi~h the City Clerk within sixty days after the final publication,
said Charter Ordinanc~ took effect on the 8th day of January, 1974.
