A CHARTER ORDINANCE EXEMPTING THE CITY OF SALINA, KANSAS, FROM THE PROVISIONS OF
K.S.A. 13-14a05, WHICH PRDVIDES FOR THE DESIGNATION AND INVESTMENT OF MONEY DERIVED FROM
TAXES AND ASSESSMENTS FOR THE POLICEMEN'S AND FIREMEN'S PENSION FUNDS, PROVIDING FOR A
MINIMUM RESERVE FOR EACH FUND, FOR THEIR RETIREMENT SYSTEMS AND PROVIDING SUBSTITUTE AND
ADDITIONAL PROVISIONS ON THE SAME SUBJECT.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Thaf the City of Salina, Kansas, a city of the first class, by the
powers vested in it by Ar[ icle 12, Section 5 of the Constitution of the State of Kansas,
hereby elects to and doesl exempt itself from and making inapplicable to it, K.S.A. 13-14a05
which applies only to cit es of the first class and is not applicable uniformly to alt cities
in Kansas, and provides sJbstitute and additional provisions on the same subject as follows,
to-wit:
"13-14a05. Designation of Funds; investment.
The alnount of money derived from taxes herein levied and
all money -eceived from assessments, dues, donations for the
benefit of such funds shall constitute funds to be known and
designated, respectively, as the Policemen's Pension Fund
and the Fi-emen's Pension Fund, which funds shall be devoted
exclusivel I to and for the purposes hereinafter enumerated.
All moneys derived from the taxes so levied and money received
from other!~sources as above enumerated shall be paid into the
Poi
icemen'~ Pension Fund or the Firemen's Pension Fund, as
the case m~y be, and shall be cumulative until a reserve fund
of not les~ than $10,000.00 shall be built up for each fund.
The amount/of, each reserve fund over $10,000.00 shall be
determined~by the Governing Body of the City; when each reserve
fund, as st determined, shall reach its maximum, further tax
levies sha~l be made only for the purpose of maintaining each
fund at sa~d level.
"All r~oneys accumulated under the provisions of this act
shall be dE ~osited by the treasurer in the same manner as other
City funds Provided, however, the Board of Trustees may, at
their optic~n, invest any of said reserve funds in any investments
which are ~uthorized for the investment of Other municipal funds."
Section 2. Thi ordinance shall be published once a week for two consecutive weeks
in The Salina Journal, th( official city newspaper.
Section 3. Thi is a Charter Ordinance and shall take effect sixty-one (61) days
after final publication, inless a sufficient petition is filed and a referendum held on the
ordinance as provided in ~rticle 12, Section 5, Subdivision (c) of the Constitution of Kansas,
in which case the ordinante shall become effective, if approved by a majority of the electors
voting thereon.
Adopted by the (~overning Body by not less than two-thirds of the members elect
votin~i~h"f~vpr thereof, nd approved by the Mayor this 29th day of March, 1971

The foregoing Charter 0rdinance Number 7 was passed on the 29th day of
March, 1971, as shown b~ the Journal of Proceedings Number 23, Page 285, by a vote
of five for and Zero ag~ inst, being not less than two-thirds of the members-elect
of the Governing Body, ublished in The Salina Journal, the official city newspaper
on the 1st day of April 1971, and on the 8th day of April, 1971, being once a week
for two consecutive weel:s, and there being no petition demanding a referendum
filed with the City Clerk within sixty days after the final publication, said
Charter Ordinance took :ffect on the 8th day of June, 1971.
