06 Police & Fire Retirement CHARTER ORDINANCE NUMBER 6 (First Published in The Salina Journal ~L~ , 1971) A CHARTER ORDINANCE EXEMPTING THE CITY OF SALINA, KANSAS, FROM THE PROVISIONS OF K.S.A. 13-14a06, WHI£H PROVIDES FOR MEMBERSHIP FEES AND CONTRIBUTIONS BY OFFICERS AND MEMBERS OF THE FIRE AND POLICE DEPARTMENTS FOR THEIR RETIREMENT SYSTEMS AND PROVIDING FOR REFUNDS UPON TERMINATION OF SERVICES WITH SAID DEPARTMENTS AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT. BE IT ORDAINE[ by the Governing Body of The City of Salina, Kansas: Section 1. TPat the City of Salina, Kansas, a city of the first class, by the powers vested in it by ~rticle 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and do(Is exempt itself from and making inapplicable to it, K.S.A. 13-14a06 which applies only to c~ties of the first class and is not applicable uniformly to all cities in Kansas, and pl'ovides substitute and additional provisions on the same subject as follows; to-wit: "13-14a0~. Membership fee and contributions by officers and members of department; refunds; limitations. Eve-y new officer and member of said police and fire departmelts shall be required to pay to the treasurer of said board a Inembership fee of five dollars, and there shall be deducted from the salary of every officer and member of each departmelt not less than three percent nor more than ten percent of his m~nthly salary, the exact amount of which shall be determint~d by the Board of Commissioners, which shall be paid into the respective pension funds. Any officer or member whose services for any reason whatsoever, other than by transfer from the poi ce to the fire department or from the fire to the police departm~ nt, shall be terminated with the department shall be entitled, upon demand, to be paid within thirty days after such demand, the total amount of the deduction from his salary paid int8 sa d fund, less flfty percent: Provided, that in the event such officer or member shall renew his services with said department he shall, as a condition of employment, return to said fun the amount withdrawn. Provided further, that if any officer ~r member of either the police or the fire department is trane:erred from one department to the other, then said officer~or member shall notify in writing the Board of Trustees of the ~ension Fund of which he was a member of his transfer and thereupon any accrued contributions made by him to the pension fund and any accumulated credits or benefits to which said menber would have been entitled to prior to said transfer shall b~ transferred to the pension fund of the department to which h~ is transferring, and upon application for retirement said member shall be entitled to compute his combined services with bo-h departments in determining his eligibility~ for ret i rem~ nt." Section 2. ~his ordinance shall be published once a week for two consecutive weeks in The Salina Jo~rnal, the official city newspaper. Section 3. 'his is a Charter Ordinance and shall take effect sixty-one (61) days after final publicatiol~, unless a sufficient petition is filed and a referendum held on th~ ordinance as provided n Article 12, Section 5, Subdivision (c) of the Constitution of Kansas, in which case ~he ordinance shall become effective, if approved by a majority of the electors voting th.~reon. ~'~ ~do~t~d by the Governing Body by not less than two-thirds of the members elect vo?ng ixn~avor'~ereo~, and approved by the Mayor this 29th day of March, 1971 (SEAL) AtteSt:- City Clerk The fori~going Charter Ordinance Number 6 was passed on the 29th day of March, 1971, as s,~own by the Journal of Proceedings Number 23, Page 284, by a vote of five for and z~'~ro against, being not less than two-thirds of the members-elect of the Governing ~ody, published in The Salina Journal, the official city newspaper on the 1st day of!April, 1971, and on the 8th day of April, 1971, being once a week for two consecutive weeks, and there being no petition demanding a referendum filed with the Ci y Clerk within sixty days after the final publication, said Charter Ordinance took effect on the 8th day of June, 1971~ D.
