A CHARTER oRDINANCE EXEMPTING THE CITY OF SALINA, KANSAS,
FROM THE PROVISIONS OF K.S.A. 13-14a08 WHICH PROVIDES FOR PAY-
MENTS UPON RETIREMENT TO CERTAIN MEMBERS OF THE POLICE DEPARTMENT
OR FIRE DEPARTMENT AND PROVIDING SUBSTITUTE AND ADDITIONAL PRO-
VISIONS ON THE SAME SUBJECT.
BE IT ORDAI]~ED BY THE GOVERNING BODY OF THE CITY OF SALINA,
KANSAS:
Section 1. That the City of Salina, Kansas, a city of the
first class, by the powers vested in it by Article 12, Section $,
of the Constitution of the State of Kansas, hereby elects to and
does exempt itself from, and make inapplicable to it, K.S.A.
13-14a08 which a~plies only to cities of the first class and is
not applicable u~iformly to all cities in Kansas, and provides
substitute and a~ditional provisions on the same subject as fol-
lows to wit:
13-14a~8. Payments upon retirement or discharge
from police!or fire department. Any officer or member
of any suchipolice department or fire department having
served twenty-two years or more on such department and
having reached the age of fifty years may make applica-
tion to be ~etired, and if such application is made
the respective board of trustees shall retire such offi-
cer or member and shall pay him monthly payments in an
amount equal to fifty percent of ~is monthly salary at
the date ofjhis retirement, or if he be discharged from
such department by reason of disability, or if he be
discharged for any reason, except conviction of a felony,
after having served twenty-two or more years in such
department,jthe respective board of trustees shall order
and direct ~hat said person, upon attaining the age of
fifty years~ be paid monthly payments in an amount equal
to fifty percent of the monthly salary of such officer
or member aC the date of discharge: Provided, That if
any officer or member who shall have been allowed any
benefits under this section shall thereafter be employed
for compensa~tion, the monthly payments out of the pen-
sion fund s~all be reduced, until he reaches the age of
sixty years, to such an amount, if when added to the
other compensation he receives, shall not exceed the com-
pensation he was receiving at the time he was retired or
discharged.
Section 2. This ordinance shall be published once a week
for two consecutive weeks in The Salina Journal, the official
city newspaper.
Section 3. iThis is a Charter Ordinance and shall take effect
sixty-one (61) dgys after final publication, unless a sufficient
petition is filed and a referendum held on the ordinance as
provided in Article 12, Section 5, Subdivision (c) of the Consti-
tution of Kansas in which case the ordinance shall become effective
if approved by the majoPity of the electors voting thereon.
Adopted by the Governing Body by not less than two-thirds of
the members elect voting in favor thereof and approved by the
