A CHARTER O}',DINANCE EXEMPTING THE CITY OF SALINA, KANSAS,
FROM K.S.A. 79-1! 51 AND PROVIDING SUBSTITUTE AND ADDITIONAL
PROVISIONS ON TH] SB/~E SUBJECT: AUTHORIZING AND LIMITING TAX
LEVIES IN ANY ON] YEAR ON EACH DOLLAR OF ASSESSED TANGZBLE VAL-
UATION AND PRESCt IBING AN AGGREGATE LIMIT FOR ALL CITY WIDE TAX
LEVIES; AMENDIN(; CHARTER ORDINANCE NO. 1 OF THE CITY OF SALINA,
KANSAS, AND REPE/~LING SAID ORIGINAL CHARTER ORDINANCE.
BE IT ORDAII~ED BY THE GOVERNING BODY OF THE CITY OF SALINA,
KANSAS:
Section 1. That Charter Ordinance No. 1 of the City of
Salina, Kansas, .s hereby amended to read as follows:
"That the C .ty of Salina, Kansas, a city of the first class
of less than 50,(100 population, by the power vested in it by
Article 12, Sect!.on 5, of the Constitution of the State of
Kansas, hereby e:.ects to exempt and does exempt itself from, and
makes inapplicab:.e to it, K. ~. A. 79-1951, which is not appli-
cable uniformly to all cities of the first class and that legis-
lature not havin$ established classes of cities for the purposes
of impesing tax %imitations.and prohibitions, and provides sub-
stitute and additional provisions as hemeinafter provided.
The Governing Body of the City of Salina, Kansas, is hereby
authorized and e~powered to levy taxes in each year for the fol-
lowing city purposes, but said Governing Body shall not fix a
rate of levy in any one (1) year on each dollar of assessed tan-
gible valuation ~f the city in excess of the following rates;
General 0pe~ating Fund, which shall include the fol-
lowing actiyities: General government; police depart-
ment; fire 4epartment; health and sanitation; waste
disposal; s~reets, alleys and highways; maintenance of
public buil¢iings; swimming pool; parks; animal control;
street lightning; traffic signals and parking control;
civil defen~e; airport; judgments; band; cemetery; gen-
eral improv~ment (except improvements for which special
assessments are made); and industrial fund .... 20 mills.
Provided, hcwever, that the mill levy for the library
shall be outside the aggregate tax levy prescribed by
this sectior~.
Provided further, however, that the aggregate of all
city-wide tax levies of the city, except levies for
the payment of bond and interest thereon, levies for
fire and po]ice department pension funds, and levies
for the control and eradication of noxious weeds and
levies authcrized by other statutes to be outside of
the aggrega%e is hereby limited to ~wenZy (20) mills,
less residue Sales Tax; provided, that the city may
levy a consclidated levy for the purpose above set
forth and tc be known as the General Operating Fund
and may be ncluded in the budget as a single fund for
the several functions of the city named herein."
Section 2. Charter Ordinance No. i of the City of Salina,
Kansas, is hereb repealed.
Section 3. This ordinance shall be published once a week
for two (2) consecutive weeks in The Salina Journal, the official
city newspaper.
Section ~. This is a Charter Ordinance and shall take ef-
fect sixty-one (81) days after final publication, unless a suf-
ficient petition for a referendum is filed and a referendum held
on the ordinance as provided in Article 12, Section 5, Subdi-
vision (c) of the Constitution of Kansas in which case the ordin-
ance shall become effective if approved by the majority of the
electors voting thereon.
Adopted by the governing body by not less than two-thirds
of the members elect voting in favor thereof and approved by the
Mayor this 6th day of June~ 1986.
