A CHARTER ORDINANCE EXEMPTING THE CITY OF SALINA, KANSAS,
FROM THE PROVISI0~S OF K.S.A. 17-q75~ AND PROVIDING SUBSTITUTE
AND ADDITIONAL PROVISIONS ON THE SAME sUBJECT; DEFINING THE POWERS
OF THE CITY FOR TH~ PURPOSE OF AIDING IN THE PLANNING, UNDERTAKING
AND CARRYING OUT OF ~{E URBAN RENEWAL PROJECTS LOCATED WITHIN THE
CITY AND PROVIDING THE PROCEDURE FOR THE ISSUANCE AND SALE OF
GENERAL 0BgIGATION BONDS OF THE CITY FOR THE PURPOSE OF UNDERTAKING
OR CARRYING OUT 0F AN URBAN RENEWAL PROJECT OF THE CITY.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA,
KANSAS:
Section 1. That the City of Salina, Kansas, a city of fhe
fimst class of less than 125,000 population by the powem vested in
it by Amticle 12, iSection S, of the Constitution of the State of
Kansas, hemeby elects to exempt and does exempt itself fmcs and
makes inapplicable to it K.S.A. 17-475g which is not applicable
unifommly to all cities of the fimst class and pmovides substitute
and additional pmovisions as hemeafter pmovided.
Section 2. The Govemning Body of the City of Salina, Kansas,
is hemeby authomized and empowemed fop the pumpose of aiding in
the planning, undertaking om cammying out of any umban menewal
pmoject within its compomate limits, upon such temms, with or with-
out considemation, as it may detemmine:
(a). Dedicate, sell, convey or lease any of its
intemest in any pmopemty om g~ant easements, licenses
om other mights om pmivileges themein to a municipality;
(b). Incum the entime expense of any public impmove-
ments made b~ such public body in exemcising the powems
gmanted in this section;
(c). Do any and all things necessamy to aid o~ co-
operate in the planning om caPmyin~ out of an umban menewal
plan;
(d). Lend, gmant om contmibute funds to a municipality;
(e). EnteP into agmeements (which may extend over
any pemiod, notwithstanding any provision om Pule of law
to the contma~y) with a municipality om othem public body
mespecting action to be taken pumsuant to any of the powems
gmanted by t~is act, including the furnishing of funds om
othem assistance in connection with an umban ~enewal
ject, and
(f). Cause public buildings and public facilities
including pa~ks, playgmounds, mecreational, community,
education, wares, sewem or dmainage facilities, om any
other womks Which it is othemwise empowemed to undemtake
to be fumnis~ed; fumnish, dedicate, close, vacate, pave,
install, gra~e, meg~de, pla~ 'om meplan streets, scads
sidewalks, ways om other places; plan om meplan, zone
mezone any pant of the pUblic body om make exceptions
fmcs building megulations; and cause administmative and
othem services to be fumnished to the municipality. If
at any time ~itle to or possession of any umban menewal
pmoject is held by any public body o~ govemnmental a~ency,
othem than the municipality~ which is authomized by law
to engage in the undemtaking, eammying out, om adminis-
tmation om u~ban renewal projects (including anv agency
om instmumen~ality of the United States of Amemica), the
provisions of the azmeements mefemmed to in this section
shall inume to the benefit of and may be enfomced by such
public body Om govemnmental agency. As used in this
ordinance, the term "municipality" shall also include
an urban renewal agency vested ~ith all of the urban
renewal project ~owers pursuant to the provisions of
K.S.A. 17-~756 and any amendments thereto.
Section 3. Any sale, conveyance, lease or agreement provided
for in this ordinance may be made by the governing body without
appraisal, public notice, advertisement or Dublic bidding.
Section ~. For the purpose of aiding in the planning, under-
taking or carrying out of an urban renewal project of an urban
renewal agency, the governing body may (in,~addition to its other
powers and upon smch terms, with or without consideration, as it
may determine) do and perform any or all of the actions or things
which by the provisions of Section (1) of this ordinance, the
governing body is authorized to do or perform, including the
furnishing of financial and other assistance.
Section 5. For the purposes of this ordinance, or for the
purpose of aiding in the planning, undertaking or carrying out of
an urban renewal project within the city, the governing body may
(in addition to any authority to issue bonds pursuant to K.S.A.
17-~751) issue and sell its general obligation bonds: Provided,
that before any general obligation bonds may be issued under the
urban renewal law, the city shall adopt a resolution, finding and
declaring it necessary to issue such bonds, which resolution shall
state the purpose for which said bonds are to be issued and the
maximum amount of bonds to be issued, and shall contain a statement
relating to the pmovisions for protest as hereinafter provided,
which resolution s!hall be published once each week for two conse-
cutive weeks in t~e official paper of the city, and if within
sixty (80) days a~ter the date of the last publication of said
resolution, a protiest, signed by not less than five percent (5%)
of the electors i~ the municipality, as determined by the vote
cast for secretar~ of state at the last preceding general election,
is filed with the icity clerk, the bonds shall not be issued, unless
the governing body calls an election within the time and in the
manner prescribed by K.S.A. 10-120 or any amendments thereto, and
the proposition shall receive the favorable vote of a majority of
the votes cast on the proposition.
Section 6. This ordinance shall be published once a week
for two consecutive weeks in The Salina Journal, the official city
newspaper.
Section 7. This is a charter ordinance and shall take effect
sixty-one (61) days after final publication unless a sufficient
petition for a referendum is filed ~u~d a referendum held on the
ordinance as provided in Article 12, Section 5, Subdivision (c)
of the constitution of Kansas in which case the ordinance shall
become effective, if approved by a majority of the electors voting
ther~on.
Adopted by the Governing Body by not less than two-thirds
vote of the members elect voting in favor thereof, and approved
