1208 Electric FranchiseORDINANCE No. /Z 61f AN ORDINANCE GRANTING TO THE PEOPLE'S LIGHT, HEAT AND POTTER CO., ITS SUCCESSORS AND ASSIGNS ITHE RIGHT TO CONSTRUCT, L-AINTAIN AND OPERATE AN ELECTRIC LIGHT SYSTEM IIT THE CITY OF SALIATA,KAIISAS, AND TO USE AND OCCUPY THE `,TREETS, ALLEYS AND PUBLIC GROUNDS OF SUCH CI`l'Y FOR THE EREC- TION AND MiAINTAINING OF ELECTRIC LIGHT POLES, WIRES AND CONDUITS USED IN CONNECTION THEREWIT11. Be it ordained by the 111ayor and Councilmen of the city of Salina. SECTION I: That from aid after the passing of this ordinance, for the period of tvTent-y (20) years, the right, privilege and license is hereby granted to the People's Light, Heat and Power Co., its successors arid 0(., assigns, to establish, maintain and operate and to purchase or erect, or both purchase and erect, maintain and operate the buildings and Machinery, poles, V`diresand other eauiuments that is or may be necessary for the manu- facture and distribution of electric light, heat and power within the city of Salina. n SECTION 2: That for the period of twenty (20) years from and after the passage of this ordinance the right -of -lay is heieby granted to,the said People's Light, Heat and Power Co., its successors and assig_ns,,, u-�aoii. and across all streets, alleys and public grounds of said city, for'. the plac- ing; and erection of poles or posts for, the purpose of carrying all necessary vvires and conduits for the transmission of electricity for light, heat a.nd pourer and for furnishing electric light, heat acid power to the inhabitants of the city of Salina and to the said city in its corporate e�+:pacity, whenever it may be deoired`,to contract therefor. Arid for any or all of such purposes during such reriod, the People's Light, Beat a!nd Power Co., its successors signs, are hereby authorized to purchase, erect, construct and maintain the necessary poles or posts and other suitable and safe material and attach thereto all necessary wires, conduits, insulators, bracket's arid crass-arrr_s through, upon, along or across 'streets, avenues., alleys, sidewalks or, p,ubiic grounds now and. set in such places as may not unnecessarily interfere Ua'� �n Brie--puc�rc use of the streets,alleys and public grounds. (b) That the said People's Light, Heat and Power Co.; its successors and assigns, shp11 at all times protect their vires and appliances by such insulation, coating of wires with nonconducting materials and other, appliances as are necessary to render the use of such electrical.currents safe to life and property within said city and by all such safe guards as science and experience may demonstrate will aid thereto. (c) That no lamps or wires shall be Placed or strung.at a height less than sixteen�(I6) feet above the streets,unless by the express.. permission, approved. in writing, of trie committee on streets and alleys. (d) That said People's Light, Heat a_id Polfier Co., its successors assigns, shall within '90 days from and after the passage of this ordi- riance commence in good faith the coliplete overhauling and reconstruction of the present existing electric light plant and its lines and appurtenan- ces and shall prosecute same with due diligence until said plant is put in first-class condition. ( e.) That the said People's Light, Heat and Power. Co . , its successors assigns, shall at. all times be prepared to furnish the city of Salina and to its inhabitants a good ,standard quality of electric light fo---,', it illuminating purposes, which light shall be furnished atnot to exceed the following maximum rates to the city of Salina; $6.25 per month for each 6.5 kmpere enclosed arc lamp, burning on the Philadelphia Moonlight schedule/ and � $9 per month for each 6.5 Ampere enclosed arc lamp burning all night and every night, and $I.00 per month for each .IC candle power incandescent lamp to be lighted all night a, -id every night. For the inhabitants thereof, 0I.65 for each I6 CP ine;=indescent lamp burning all night and every night, $I.00 i -int it midnight, .75 for each A C P lamp burning until I0 o'clock, and 4.60 for each I6 C P lamp burning until 8 o'clock and 5.58 for each I6 C P lar.lpI burning until 6 ofelock. To indi- viduals 4?I2 _icer montr for each 6.5 Ampere enclosed arc l.sr�p burning all night every ni.ght, ` fe4-er or greater nw-,qr:er of hours at proportionate rates. (f) Teeter rates shall not exceed $.I7 I/2 for I000 watts for residences and P.I5 per I000 watts for business houses. These rates u�il1 be subjected to a discount of IO°jo if the bill for' such services are paid by the fifth of the month following such services. The meter to be of standarc}_, r_lanufacture and calibrated within 26�0 of correct. Arid the minimum fixed charge shall not exceed �I.00 per month. (g) That 'said People's Light, Heat and Power Co..,its successors I assigns, shall not be .ailty of extortion or of charging more than the maximum prices herein specified for lights. (h) That the said Peoples Light, Hest and Power Co.,its successors gaa-assigns, shall pay the said city of Salina the cost oJ7 the -nublieation of this ordinance. SECTION 5: That during the life of this franchise permission is hereby granted to the said People's Light, Hest and Power Co., t sudeessors _q -r assigns to re_riove, under the direction of the city council, such over hanging branches and.limbs of trees as may interfere with the successful operation of said electric light system. SECTION 6: i Said People's Light, He2t and Power Co . , its successors &U& assigns shall within 30 days after the passing of this ordinance file iuith. the city.c_lerk its acceptance in writing of all^terms, conditions and stipulations hereof, which said acceptance shall be recorded by the City Clerk in the ordinance book of this city. 0 SECTION 7: This ordinance shall take effect and be in force from and after its publication once in the Salina Evening Journal.
