Ordinance No.
An ordinance granting to Frank Hageman, trustee, and his assign",
the right and privilege to establish, maintain and operate in the city
of Salina, ;Kansas, a system of' gas and light works and to supply the
said city and its inhabitants and other consumers with light and fuel
and to lay and maintain the mains and pipes for such purposes in.the
streets, alleys and public grounds of said city.
Beit ordained by the mayor and 'council 'of the city of Salinaf Maxw
Sec. 1. That there be and islllhereby granted to Frank Hageman, trustee'
and his assigns for the period�of twenty years from and after the pas-
sage of,this ordinance,the right and -privilege to establish, maintain
and operate in the city of Salina, Kansas, a system of gas*and light
works and to supply the said city and its inhabitants and other con-
sumersoohwrith light and fuel and to lay and maintain the mains and pipes.
for such purposes in.the streets, alleys and public grounds of said city.
Whenever the word "grantee" is"used in this ordinance such term shall
include the said Frank Hageman, trustee, and his assigns.
Sec. 2. . The -said grantee shall in the use of the streets,'a lleys or
public grounds of the city for ''the purposes aforesaid protect the city
and save it harmless from all damages or loss on account of any defec®
r
tive or improper work or construction�and,if a temporary removal of any
walk or paving becomes necessary in laying said mains or pipes or in req -
pairing same said walk or paving shall without unreasonable delay be re-
stored to its former position and left as good as when removed. The
rights granted under this ordinance shall be subject to all reasonable
rules and regulations` now --existing or --hereafter adopted- by -the- mayor and
city council for the protection of public and private, property.
Seca 3. That said grantee shall not charge for gas or light used for
illuminating purposes°or domestic fuel more than one dollar per one
thousand cuble feet, and for gas: used for manufacturing or other purposes •
not more than eighty cents perlone thousand cubic feet.
Sec. 4. That said grantee shall within one year from the date of the
passage of this -ordinance drill �Ior cause to be drilled within the lim-
its of Saline County, Kansas, a test well for the discovery of natural
gas, oil and coal and if neither gas, oil,or coal be discovered in pay-
ing quantities therein then that said grantee shall drill or cause to
be drilled within said county at least one additional well every six
months thereafter until gas, oil or coal has been discovered in suffi-
cient quantities to justify theexpense. of its transportation to the
city of Salina and use for light and fuel purposes, and a failure so to
do or a failure for an unreasonable time after the discovery of gas, oil
or coal in paying quantities to,, utilize he o 9pply said city$
.its inhabitants or other consumers with light and fuel at tbe prices
not exceeding the rate specified herein, shall cause this ordinance and
all rights thereunder to terminate at the option of the city council,
unavoidable accidents or unforeseen contingencies excepted.
Sec. 5. This ordinance shall ';take effect and be in force from and af-
ter its approval by the mayor, ,its publication once in the Salina Eve-
ning. Journal and its acceptance',in writing by the grantee, which accept-
ance shall be filed with the city clerk within days after t
