An Ordinance Providing for Lighting the Streets of the City of Sa-
lina,Kansas.
BE IT ORDAINED by the Mayor and Councilmen of The City of Salina,
Kansas:
SECTION-I.That the Mayor of The City of Salina, Kansas, be and he is -------
hereby authorized for and on behalf of The City of Salina to exe-
cute the following contract for lighting streets,viz:
CONTRACT.
This Agreement,Made this 3Ist.day of December A.D.1898,by and
between G. I. Girty,party of the first part, and the City of Salina,
Kansas,T)arty of tine second part,Witnesseth: That in consideration
of the payments herein mentioned to be made by the second party, the
-first -party agrees,during a period of five years from this..dat.e.,to.
continually fur,nish,inaintain and op erate,for the use and benefit of
the second party , thirty four(34) are lamps of 2000 candle power
each,,at such places in said city as may be hereafter designated by
the Mayor and Council of said city, each of said arc lamps to be '
suspended not less than 33 feet above the surface of the street
where located;said lamps to be maintained in good -working order and
to be lighted and extinguished in accordance with what is known as
"The Philadelphia Moon Clause, "that is,to be lighted one-half hour
after sunset and one half hour before moonset,and extinguished one-
half hour before sunrise and one-half hour after moonrise.
It is further- agreed and understood,that said lights shall be
extinguished
during such hours after
midnight As may
be designated
by the ";Mayor
and Council and that on
dark or cloudy
nights,said
lights shall be kept lighted during such additional hours as may
be required by the written order of ,the Mayor of said city;and the
hours of such additional services shall be paid for at the rate of
33100.00 for 2000 hOUrs,and the hours when such ligkits,or any of
them,are so extinguished or not in actual operation shall be de-
ducted from the price to be paid at the same rate:it being under-
stood that said city shall Fay for such lights only for such time
as they are kept lighted and in actual operation,at the aforesaid
rate of $3100.00 for 2000 hours.
And the first party further agrees that during the continuance

of this contract,he will continuously furnish and operate for the
use and benefit of the second party,without charge or expense to
said city,one fifty candle power incandescent street lamp,one six-
teen candle power street lamp and the seventeen 16 candle power
lamps now used by the city in and about its buildings.
And the first party further agrees that he will furnish such
additional are lamps of 2,000 candle power each as may be required
by the second party during the continuance of this contract,at the
rate of S75-00 per lamp per year of 2000 hours.
And in consideration of the faithful performance of the condi-
tions above set forth,by the first party,the second party agrees to
pay first party for said are lights at the rate of Thirty One Hun-
dred(3100)Dollars p.,er year of 2000, hours,payable in monthly pay-
ments.
It is further mutually agreed that in case the first party
shall fail to faithfully perform all the conditions of this con-
tract,the second party may terminate and cancel this contract by
giving thirty days notice thereof to first party.
The first ?Darty shall commence the lighting of said city under
and as required by.. this contract within ninety days from this date,
or this contract Will be void.
In Witness Whereof' the first party has hereunto set his hand,

SECTION 2. This ordinance shall take effect and be in force from and
