2173 Extend Ash Streetx.12 ORDINANCE N0. 2173 An ordinance providng for exchange of land for extension of cer- tain streets and extending Oakdale Avenue. WHEREAS, it is the desire of the Mayor and Council to extend Oakdale Avenue from its present terminus from Ash Street south to Johnstown Avenue in the City of Salina, Kansas, and WHEREAS, it is the desire to use 'as a portion of such street and alley between said Ash Street and said Johnstown Av- enue, and WHEREAS, certain persons in the City of Salina, Kansas, are willing to convey to the City of Salina, Kansas, certsin tracts -of land in exchange for certain land being used by said City for said alley between said Ash Street and Johnstown Aven- ue as aforesaid and that by making such exchange the said Oak- dale Avenue will extend north and south between Ash Street and Johnstown Avenue, and WHEREAS, it is deemed advisable to make such exchange for the purpose of extending said Oakdale Avenue as aforesaid, Now, Therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That the Mayor and City Clerk are hereby auth- orized and empowered to execute and deliver unto F. H. Rehm a good and sufficient deed conveying to said F. H. REhm for one dollar and other good and valuable consideration, that tract of ground described as follows: Commencing at a point 55 feet east of the northeast corner of Lot 22 Atherton Phillips Addition to the City of'Salina, Kansas; thence east 35 feet; thence south 160 feet; more or less to the west line of a 33 foot alley; -thence -ina northwesterly direction along the Wiest line of said 33 foot alley to the place of begin- ning. Sec. 2. That the Mayor and City Clerk are hereby author - iced and empowered to convey to The Vit. Johns Hospital that tract of land described as follows: Commencing at a point 135 feet east of the southeast corner of Lot 1, Atherton Phillip's Addition to the City of Salina, Kansas; thence north on a, line para- llel to the east line of Block ll, Riverside Park Addi- tion 140 feet more or less to its intersection with the east line of a 33 foot alley; thence in a south- easterly direction to a point on the north line of Johnstown Avenue 34 feet east of the place of begin - ping; thenve west along the north line of Johnsotnw Avenue 34 feet to the place of beginning. 1 1 1 u 1 See. 3. That the Mayor and City Clerk are hereby author - ized to accept for and on behalf of said City to be used as a public street and highway from F. H. Rehm that tract of land de- scribed as follows: Commencing at a point 90 feet east of the southeast corner of Lot 1, Atherton -Phillip's Addition to the City of Salina, Kansas.; thenve north 217 feet to the north line of a 33 foot alley; thenve in a southeast- erly direction along the west line of said alley to a point 45 feet east of the place of beginning on the north side of Johnstown Avenue; thence west 45 feet to the place of beginning. Also that tract of land to be used as an alley commencing at a point 180 feet south of the northeast corner of Lot 2, Atherton -Phillips Addition to the City of -Salina, Kansas; thence east 90 feet; thence south 17 feet; thence west 90 feet; thence north 17 feet to the place of beginning. Both tracts of land being a part of Lot 2, Surveyor's Plat "G", in the southeast quarter of Section 12-14-3 west. Sec. 4. That the Mayor and City Clerk are hereby author- ized to accept from the St. John's Hospital to be used as a pub- lic street and highway a deed to a tract of land described as follows: Commencing at the northwest corner of B lock 11, Riverside Park addition in the city of Salina, Kan- sas, thence east 14.feet; thence south parallel to the west line of said Block 113, 237 feet to the in- tersection with the east line of a 33 foot alley; thence in a northwesterly direction along the east line of said alley to -its intersection'with the .. west line of Block 11; thence north along said gest side of said Block 11 to the place of beginning. Sec. 5. Upon the delivery of proper deeds to the Mayor and Clerk of the property hereinbefore described, the Mayor and City Clerk shall execute and deliver the deeds mentioned herein to the parties entitled thereto and the land so conveyed to said City shall' -'be used and dedicated to the public as a street and high- way from Ash Street to Johnstown Avenue and be known as Oakdale Avenue.
