2171 Issue Sewer Bonds1 -7 1 L 1 ORDINANCE N0. 2171 (Published in the Salina.2ajjL Union April 20th, 1918) An ordinance providing for the issuance of Sewer Improvement Bonds of the City of Salina, Kansas, in the sum of 9,848.35 WHEREAS, The Mayor and Council of the city of Salina, Kan- sas, have caused to be built and constructed certain sewers in said City as provided in Ordinances No. 2044, 2119, 2139 and an addition- al sewer between Minneapolis and Beloit Avenues in said City, the total price of which is in excess of $9.848.35; Now, Therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That the cost of such sewers shall be payable in ten (10) annual installments instead*of levying the entire taxes for such cost at one time, the first installment of which is to be paid with the taxes for the year 1918 and one installment each year thereafter until the whole of such sum is paid'and that for such installments there shall be issued sever improvement bonds of the City of Salina, in the total sum of 9,848.35 as herein provided. Sec. 2. Said issue of bonds shall consist of nineteen (19) bonds of the denomination of Five Hundred (500.00) Dollars each and one bond of- the denomination of Three Hundred Forty -Eight and 35100 (348.35) Dollars, They shall be dated February lst, 1918, and payable as follows: $848.35 on the first day of February, 1919 and $lYOOO.00 on the first day'of February in each year thereafter for a per- iod of nine ( 9) years. Sec. 3. Said bonds shall bear interest at the rate of 4-3/4% per annum such interest to be p , payable semi-annually on the 1st day of August and February of each year, except the first installment of interest, which shall fall due upon the 1st day of'February, 1919. Such bonds shall have interest coupons attached and both bonds and coupons shall be payable at the fiscal agency of the State of Kan- sas, in the City of Topeka, Kansas. Sec. 4. Said bonds shall be signed by the Mayor and attested by the Clerk of the city of Salina, Kansas, and shall have the cor- porate seal of said City attached thereoto. Interest coupons to said bonds shall be signed by said Clerk. Sec. 5. Said bonds shall be executed in the form and shall con- tain recitals substantially as follows: UNITED STATES OF AMERICA. . NO. _ KNOW ALL MEN BY THESE PRESENTS, ThatCity of Salina in the county of Saline and State of Kansas, for value received, hereby acknowledges itself to be indebted -and promises to pay the sum of 0 in lawful money of the United'States of America on the 1st day of A." D. 19--t - -with- -iht-er- est 9-,--with--inter- est thereon at the rate of four and three-quarters per cent per annum, the first installment of which shall be payable - February, 1919, and interest payable semi-annually thereafter on the first day of August and February of each year after the date hereof until the principal sum shall have been paid, upon the presentation and surrender of the proper interest coupon hereto attached, bearing the signature of the Clerk of said City, as they severally become due and payable. Both principal and interest are payable at the fiscal agency of the -State of Kansas in the City of Topeka, Kansas; and the. City of Salina, Kansas, is held and firmly -bound and- its faith and credit andall real -and personal property in said -City - are hereby pledged for the prompt payment of the principal and interest of this bond upon their maturity. This bond is one of a series of bonds -of -like date and tenor - issued by said City -of Salina; Kansas, to pay for -sewer improver_ents in and -for said City under and by the authority' of -and'in compliance -with the provisions of the laws of the -State of Kansas governing cities of the second class, and- iri compliance with an ordinance duly and legally passed by the Mayor and Council of said City on the 15th day of April, A—D. 1918. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist prece- -dent to and in the issuance of this bond, have been properly. done and performed and do exist in regular and due form as required by the constitution, and laws of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statu- tory limit. IN WITNESS WHEREOF, said City of Salina, by its Mayor and Council, has caused this bond to be signed by its Mayor and attested by its Clerk, and its corporate seal is hereto attached. Dated this day of A. D. 1918. Attest: Mayor. City Clerk. Sec. 6. The first interest coupon to be attached to said bonds shall be substantially as follows:. 6 NO. On the first day of February, 1919, the City of Salina, Kansas, will pay to the bearer at the fiscal agency of the State of Kansas in the City of opeka, Kansas, the same being one year's interest on its Improvement -bond dated February lst, 1918. On the first day of 19 , the City of Salina, Kansas, will pay to the bearer j at the fiscal agency of the'State of Kansas,'in the city of Topeka,'Kansas, the same being six months interest on its Sewer Improvement Bond February lst, 1918. The Mayor and Clerk are hereby authorized and di- rected to prepare and execute, as soon as practicable, the said bonds hereby provided for, therein pledging the credit of the said City for the payment thereof, and when executed, said bonds shall be by the Mayor and Councilmen sold, for not less than their par value, and out of the proceeds thebeof shall be paid the cost of building and constructing the sewers aforesaid; and the Mayor and Council shall make provisions annually for the pay - merit of the pricipal and interest of said bonds as the same shall become due, by levying an assessment on the property liable there- for. The Mayor and Clerk are hereby authorized and directed to prepare and execute, as soon as practicable, the said bonds here- in provided for, therein pledging the credit of the said City for the payment thereof, and when executed, said bonds shall be by the Mayor and Councilmen sold, for not -less than their par value, and out of the proceeds thereof shall- be paid the cost of building .and constructing the sewers aforesaid; and the Mayor and Council shall make provisions annually for the payment of the principal and inter- est of said bonds as the same shall become due, by levying an assess- ment on the property liable therefor.
