2158 Improve Ash Street1 1 C� 1 ORDINANCE NO. 2158. the Salina U 1918 An ordinance specifying and selecting the paving material to be used and letting the contract for the paving and excavating of certain streets in the City of Salina, Kansas. Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. The Mayor and Council hereby determine that Ash Street, in the City of Salina, from the east side of Third Street to the west side of FPont Street shall be paved with one -course Vitrified vertical fiber side wire out Buffalo Brick raving Blocks, or brick equally as good, two and one-half (22) inches deep with Texaco Asphaltic Filler, or filler equally as good, on a four (4) inch Portland Cement Concrete Base with one and onel-�half (11) inch sand cushion. Such pavement within the limits above deflined shall be 41 feet in width from gutter to gutter. All excavating, rolling and filling necessary for the proper construction of such pavement shall be done and such pavement shall be laid and constructed on the established grade of such streets and shall return to the lot line at the intersection of said street with any other street or alley. Sec. 2. All excavating, filling and rolling necessary for the proper construction of such improvements shall be made and done in strict conformity to and in compliance with the plans and speci- fications heretofore made by the City Engineer and now on file with the City Clerk, which plans and specifications are hereby incorpo- rated in and made a part hereof in all respects as fully and complete- ly as though written out at length herein. Such plans and specifica- tions are hereby adopted as and for the plans and specifications for such work and improvement. Sec.. 3. The contract is hereby awarded to M. R. Amerman of Salina, Kansas, for the paving, excavating and filling of the above mentioned street within the limits above defined with the naterial specified in Section One (1) hereof, at a price of $2.02 per square yard for such pavement actually laid and put in place on said street and the said M. R. Amerman shall be paid the price of forty0eight (48�) cents per cubic yard for all dirt actually removed from such street; all of said pavement and excavation is to be paid for accord- ing to the measurement thereof by the City Engineer of the City of Salina, and the Mayor and Council hereby find and determine that the price herein agreed and spefied to be paid for the improvements afore - .said are less than the estimated price and cost of such as made and furnished by the City Engineer and now on file with the City Clerk. ikm Section 4. Such contract is awarded upon the express condition that such work and improvement shall be done in strict accordance with and in compliance with the plans and specifications of the City Engineer therefor, which are hereby made a part of this ordinance, and of the contract hereby awarded, and upon the further condition among others, that the said M. R. Amerman, shall give to the City of Salina, a surety bond in the approximate sum of the costs of such improvements, guaranteeing the proper and workmanlike construction of all of such improvements and guaranteeing such pavement against all defects for a period of five (5) years from the date of its completion and acceptance by said City.
