2139 Sewer Improvements Eleventh Street1 1 1 1 1 ORDINANCE NO. 2139. (Published in the Salina Daily Union January 1918) An ordinance providing for the construction of certain sewers in the City of Salina, Kansas, letting the contract therefor and providing for the payment of the cost thereof. WHEREAS, plans and specifications of certain sewers herein - after described have been made and prepared by the -City Engineer and have been approved by the Mayor and Council, and WHEREAS, bids for the construction of such sewers have hereto- fore been advertised by saud City and are now on file with the City Clerk, Now Therefore, Be* it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That the Mayor and Council deem it necessary and hereby order that the following described sewers be built and con- structed and the following described manholes and catchbasins be built and constructed thereon at and for the following mentioned price: 250 feet of 10=inch sewer on Eleventh Street; commencing at the man- hole'oh Charles St reet`and running south'on said Eleventh Street at and for the price of 70¢ per lineal" foot. 1 manhole at and for the price of $37.00 Sec. 2. The plans and specifications of the City Engineer of the City of Salina for the sewers above described, dated November 5th, 1917, and now on file with the City Clerk are hereby adopted and approved hp and for the plans and specifications for the above described sewers and are hereby made apart of this ordinance as ful- ly as if set out in full herein, and all the work herein specified and described shall be done in accordance and in compliance with such plans and specifications and under the direction of the City Engineer. Sec._ 3. The contract is hereby let to C. T. Snyder for the building and construction,of the sewers, catchbasins and manholes heretofore described at and for the prices hereinbefore set out, Sec. 4. It is hereby found and determined that the prices hereby agreed to be paid for each of said sewers, catchbasins, and manholes, is less than the estimated.eost of such sewers, catch - basins and manholes, and the.estimates made by the City Engineer therefor and now on file with the City Clerk. Sec. 5. The person to whom said contract is awarded as afore- said, shall execute a written contract with said City for the purpose of building such sewers, catchbasins and manholes as aforesaid, and shall file with the City Clerk a good and sufficient bond in the total 27 f 28 t� . Cr sum of said contract, conditioned that he will build such sewers according to said specifications; that he will refill the ditches made in the streets and alleys under which such sewers shall be laid and constructed; that he will fulfill the guaranttee re- quired in said specifications; and that he will hold and save harmleks the City of Salina from all damage to persons and property which may arise through the carelessness or neglect of said contractor or his servants and employees; that he will protect said City from all liens or cliams for labor and material used and employed in the building of such sewers. Sec. 6. The cost and expense of constructing such sewers shall be assessed against all lots and pieces of ground contained in the City of Salina as a sewer district, as provided by Ordinance No. 613, passed and approved December 23rd, 1887, and the Mayor and Council are hereby authorized to provide for the payment of the cost thereof by installments instead of levying the entire tax or special assessments at one time, and for such installments they may issue sewer improvement bonds of the City of Salina, payable in installments of equal amounts each year, none of which bonds nor the installments thereof shall run longer than ten years or bear interest exceeding five per cent per annum, and such bonds may be delivered to the contractor building such sewers In payment thereof or the Mayor and Council may sell said bonds at not less than their par value and pay said contractor out of the proceeds thereof, and for the purpose of paying prin- cipal and interest on said bonds, as they severally become due, the Mayor and Council shall each year, during the life of said bonds, levy an assessment or speicial tax against all taxable real estate in said City at the assessed value thereof for gener- al revenue purposes, in an amount sufficient to pay the princi- pal and interest of said bonds for that year; and the City Clerk shall certify said assessments and special taxes as they are sev- erally made and levied as aforesaid, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes of said City are certified. Sec. 7. That said contractor shall properly refull all excavations made in the construction of the above described sewers according to the plans and specifications of the City Engineer therefor, and shall properly refill said excavations if any sinking or depression appears therein wuthin a period of one year after the acceptance of said sewers by the aforesaid City. 1 1 1 11 LI n 1 1 1 Sec. 8.
