2137 Improve Ash Street22 ORDINANCE NO. 2137. (Published in the Salina Daily Union Tanuary 1glS) An ordinance providing for the excavating, grading and paving of certain streets in the city of Salina, Kansas, specifying the manner of construction, providing for the cost thereof and the manner of payment. WHEREAS, by resolution passed and approved by the Mayor and Councilmen of the City of Salina, upon the 19th day of ft"ffld ber, 1917, it was resolved that Ash Street, from the west line of Fourth Street to the east line of Third Street in said City, should be excavated, graded and paved, and WHEREAS, by resolution duly passed and approved by the Mayor and Councilmen of the City of Salina upon the 3rd day of December, 19172 it was resolved that Elm Street, from the west line of Fourth Street to the east line of Third Street, should be excavated, grad- ed and paved, and, WHEREAS, within the time allowed by law therefor no protest was entered or filed against any of the work and improvements, Now, Therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that Ash Street in the city of Salina, Kansas, from the west line of Fourth Street to the east line of Third Street; and Elm Street, in said City, from the west line of Fourth Street to the east line of Third Street, should each and all be excavated, graded and paved with such material as the•Mayor and Councilmen shall hereafter se - lett and designate, such paving to be made of such width as the Mayor and Council shall hereafter determine and shall extend to the lot line on such streets at the intersection of such streets with any other street or alley. Sec. 2. Ali. excavating, rolling and grading for the proper construction of such paving, grading and excavating shall be done and such paving, grading and excavating shall be laid and construct- ed on the established grade of said streets as heretofore or here- after established by the ordinances of the City of Salina. Sec. 3. The City Engineer's plans and specifications and estimates of cost for the making of the improvements herein provid- ed for, filed with the City Clerk on the 7th day of January, 1918, are hereby adopted and approved by the Council. 1 1 1 C 1 1 U 1 1 The Mayor and Council shall hereafter by ordinance ^determine the kind of paving to be placed on the above described streets, and shall let a contract for the construction of such paving to the most satisfactory and responsible bidder or person. Sec. 5. After the passage and publication of this ordinance the Mayor and Council shall appoint three disinterested household- ers of the City who, after having taken an oath to faithfully and impartially appraise all lots and pieces of ground, liable to assessment and taxation for the cost of said improvements, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxa- tion for such improvements, without regard to the improvements thereon, and after the making of said appraisement, shall return the same to the Mayor and Council, and after such appraisement is returned to the Mayor and Council, the said Mayor and Council shall designate a time for holding a special session for the purpose of hearing complaints and equalizing said appraisements, of which special session, due notice shall be given in the official City paper, and at said special session the Mayor and Council shall, if they deem it just and proper alter or change such appraisement. Sec. 6. For the purpose of paying for such paving, grading and excavating, the Mayor and Council are hereby directed and auth- orized to issue bonds of the City of Salina, in an amount not to exceed the contract price therefor, and to run for such a period of time as the Mayor and Council shall determine, not to exceed, how- ever, ten years, from the date of such bonds, adn to be payable in equal amounts each year during the life of such bonds, toegehter with interest not to exceed the rate of five per cent per annum, which bonds shall be payable at the fiscal atency of the State of Kansas, and for the purpose of paying the principal and interest on such bonds as they severally become due, the Mayor and Council shall each year during the life of such bonds, levy asessments against the lots and pieces of ground liable for taxation for the improvements herein provided for, in an amount sufficient to pay the principal and in- terest for that year; Provided that for the purpose of defraying the cost of paving and excavating the squares formed by the crossing of the streets and alleys, as well as where the improvement is througi or adjacent to City property, for which the city would be liable, the assessment shall be made against all of the taxable property of the City, and the City Clerk shall certify said assessments .as they 23 24 severally made, to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certi- fied, and said assessment shall be liable to the same penalties as other taxes: Provided, that the Mayor and Council shall by ord- inance apportion and assess the special assessments aforesaid against the lots and pieces of ground in the taxing districts for said improvements, which assessment and apportionment shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements.
