ORDINANCE NO. 2136.

An ordinance providing for the paving,.curbing, guttering, exca-
vating and grading of Phillips Street, from the south line
of South Street' to the north line of Morrison Avenue, speci-
fying the manner of construction,'providing for the cost
thereof and. the .manner, of payment.
WHEREAS, a petition has been presented to the Mayor and
Council requesting the Mayor and Council to pave, curb, gutter,
excavate and grade Phillips Street in the city of Salina, Kansas,
from the south line of South Street to the north line of Morrison
Avenue, and,
WHEREAS, said petition has been examined and found to contain
the names of a majority of the resident owners of real property
liable for taxation, Now, Therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That it is necessary and hereby ordered that
Phillips Street in the City of Salina, Kansas, from the south line
of South Street to the north line of Morrison Avenue be paved
with such material as the Mayor and Council shall hereafter select
and designate. Such paving to be of such width as the Mayor and
Council shall hereafter determine and shall extend to the lot line
on such street at the intersection of such street with any other
street or alley.
Sec. 2. It is hereby necessary and_.hereby ordered that
said streets, within the limits aforesaid, be curbed and guttered
on both sides thereof with cement curb and gutter, the curb part
thereof to be six (6) inches in thickness and the gutter part there-
of .to be forty-two (42) inches in width from the back edge of such
curbing and guttering to the paving line on said streets. The lot
line edge of such curbing and guttering shall be set such distance
from the center of said streets as the Mayor and Council shall here-
after deterimine; Provided, however, that at the intersection of
such street with any other streets -and alleys such curbing and gutter-
ing shall return to the lot line of such streets.
Sec. 3. All excavating, rolling and grading for the proper
construction of such paving, curbing, and guttering shall be done
and such paving, curbing, guttering shall be laid and constructed
on'the established grade of said streets as heretofore or hereafter
established by the ordinances of the City of Salina.
Sec. 4. The City Engineer's plans and specifications and esti-
mates of cost for the making of the improvements herein provided for,
filed with the City Clerk on the 7th day of Uanuary, 1918, are here-
by adopted and approved by the Council.
Sec. 5. The Mayor and Council shall hereafter by ordin-
ance determine the kind of paving, curbing, and guttering to be
placed on the above described streets, and shall let a contract
for the construction of such paving, curbing, and guttering to
the most satisfactory and responsible bidder or person.
Sec. 6. after the passage and publication of this ordinance
the Mayor and Council shall appoint three disinterested house-
holders of the City, who, after having taken an oath to faithful-
ly and impartially appraise all lots and pieces of ground liable
to. assessment and taxation for the cost of said improvements, shall,
within ten days after having been notified of their appointment,
proceed to appraise said lots and pieces of ground liable to taxa-
tion for such improvements, without regard to the improvements
thereon,, and after making said appraisement, shall return the same
to the Mayor and Council, and after such appraisement is returned
to the Mayor and Council, the said Mayor and Council shall desig-
nate a time for holding a special session for the purpose of .hear-
ing complaints and equalizing said appraisements, if which special
session due notice shall be given in the official City psis, and
at -said speeial session the Mayor and Council shall, if they deem
it just and proper, alter or change'such appraisement.
Sec. 7. For the purpose of paying for such paving, curbing,
guttering, excavating, and grading, the Mayor and Council are here-
by directed and authorized to issue bonds of the,City of Salina,
in an amount not to exceed the contract price therefor, and to
run for such a period of time as the Mayor and Council shall de-
termine, not to exceed, however, ten years, from the date of such
bonds, and to be payable in equal amounts each year during the
life of such bonds, together with interest not to exceed the rate
of five per cent per annum', which bonds shall be payable at the
fiscal agency of the State of Kansas, and for the purpose of pay-
ing•the principal and interest on such bonds as they severally be-
come due, the Mayor and Council shall each year during the life
of such bonds, levy an assessment against the lots and pieces of
ground liable for taxation for the improvements herein provided for,
in an amount sufficient to pay the principal and interest for that
year; Provided, that for the purpose of defraying the cost of pav-
ing and excavating the squares and areas formed by the crossing
of the streets and alleys, as well as where the improvement is
through or adjacent to City property, for which the City would be

lible, the assessment shall be made against all of the taxable
property of the City, and the City Clerk shall certify said assess-
ments as they are severally made, to the County Clerk of Saline
County, Kansas, at the same time and in the same manner as other
taxes are certified, and said assessments shall be liable to the
same penalties as other taxes; Provided, that the Mayor and Coun-
cil shall by ordinance apportion and assess the special assess-
ments aforesaid against the lots and pieces of .ground in the tax-
ing -districts for said improvements, which assessment and apport-
ionment shall hold good for all the installments that are to be
collected from the specific property chargeable with said improve-
ments/
Sec. 8. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.
