1914 Issue Improvement Bonds1I AY 451 O R D I N A N C E N 0. 1914 (Published in the Salina Evening Journal January 2 , 1916.) An ordinance providing for the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of $47,952.35, to pay the cost of improving certain streets in said -City. WHEREAS, in pursuance to proceedings duly had according to law, contracts have been let and performed for the paving, curbing, guttering and excavating Baker Street, between the south line of Iron Avenue and the north line of Walnut Street; Iron Avenue between the west line of Penn Avenue and the west line of Delaware Street; Ninth Street, between the south line of South Street and the south line of Crawford Avenue, all such streets and improvements in the city of Salina, Kansas; and, WHEREAS, in pursuance of proceedings duly had according to law, c ont raet s have been let and performed for the paving, curbing, guttering and excavating of Ash Street, in the city of Salina, Kansas, between the west line of College Avenue and the east line of Railroad Street, and for the curbing and guttering of Fifth Street in the city of Salina, Kansas, between the . south line of Walnut Street and the north line of Prescott Avenue, and for the paving, curbing, guttering and excavating of Thirteenth Street in the city of Salina, Kansas, between the north line of Ash Street and the north line of Bishop Street extended due west from Ninth Street, and; WHEREAS, the total cost of said improvements have been ascert- ained to be the sum of 58,857.53, and the portion thereof to be paid by a general tax t'o be levied on all taxable property within said City of Salina, Kansas, for the improvement of the squares and areas formed by the intersection of. streets and alleys, and for city property, and for which bonds are to be issued as hereinafter provided, has been as- certained and is hereby determined to be the sum of 8,135.34, and the portion thereof to be paid by special assessments levied upon the lots and pieces of ground liable therefor., payable in ten (10) annual installments according to law, and as provided in Ordinances numbered 1818, 1846, 18472 18192 1838 and 1824 of the city of Salina, Kansas, has been ascerta=ined and is hereby determined to be the sum of $50,,722.19, and the amount of said special assessments for which bonds are to be issued as herein provided, in anticipation of said special assessments which remain unpaid has-been ascertained and is hereby determined to be the sum of 39,817..01, the difference between the last two named amounts in the sum of $10..905.18 having been paid by the property owners on said streets, whose property has thereby been discharged from any further assessment for the cost of said improve- ments, in the amounts so paid, Therefore, Be it ordained by the Mayor<:,-a;rid Councilmen of the City of Salina: Sect ion 1. That the cost of said street improvements, after deducting therefrom the, assessments heretofore paid thereon as afore- said, including the cost of the improvement of the squares and areas formed by the intersection of streets and alleys, and of streets ad- jacent to city property, shall be paid in ten (10) equal annual install- ments, the first 'installment to be paid with the taxes for the year 1916, and one installment with the taxes for each succeeding year thereafter until the whole is paid, and that for such installments there shall be and ,are hereby issued Improvement Bonds of the city of Sa- lina, Kansas, in the aggregate sum of $47,952.35, as hereinafter provided. Sec. 2. Said issue of bonds shall consist of ninety (90) bonds ,of the denomination of Five Hundred Dollars, (500.00) each, nine (9) bonds of the denomination of Three Hundred Dollars, ($300.00) each, and one (1) bond of the denomination of Two Hundred Fifty -Two and 35100 Dollars, (252.35) numbered from One (1) to one hundred (100) inclusive, all bearing interest at the rate of four and three-quarters (4.a) per cent per annum, payable January lst, and July lst of each year after the date of said bonds , which shall be January 1st., 1916, said bonds shall have interest coupons attached and shall become due and payable as follows, to -wit: Nine (9)-- Five Hun - Bred Dollar ($00.00) bonds, and one (1) bond of Two Hundred Fifty - Two and 35100 Dollars, ($252.35), on January lst, 1917, and Nine (9) , Five- Hundred Dollar (500.00) and one (1) , Three Hun- dred Dollar, (300.00) bond due on the 'lst day of January of each year thereafter for a period of nine years (9) years, and until all are paid. Sec. 3. Said bonds shall be signed by the Mayor and att est = ed by the City Clerk of said City, and shall have the corporate seal of said City attached thereto, and the interest coupons of said bonds shall be signed by the city clerk,' and both bonds and interest coupons shall be payable at the fiscal agency of the Mate of Kansas. Sec 4. Said bonds shall be executed in the form and shall contain recitals substantially as follows: UNITED STATES OF AMERICA STATE OF KANSAS CITY OF SALINA NO. KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, and State of. Kansas, for value received, hereby acknowledges itself to be indebted to and promises to pay to the bearer the sum of 4 in lawful money of the United States, on the first day of January, 19 , with interest thereon at the rate of four and three-quarters—per cent per annum, payable semi-annually on the first days of January and July of each year after the date hereof until the principal sum shall have been paid, upon the presentation and surrender of the proper interest coupon hereto attached bearing the signature of the city clerk .of said City, as they severally become due, and both principal and interest are payable at the fiscal agency of the State of Kansas, in the city of Topeka, Kansas; and said City -of Salina is held and firmly bound, and its faith and credit: -and :a11 °real._. nd . personal property • in said City are hereby pledged for the prompt payment of the principal of this bond and the interest at maturity. This bond is one of a series of bonds of like date and tenor issued by the City of Salina, to pay for street improvements in and for said city under and by authority of and in complaiance with an ordinance duly passed and approved by the mayor and council of said city on the 3rd day of January, 1916. And it is hereby declared and cert if ied that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond have been •properly done and performed and do exist in the regular and due form required by law and the constitution of the State of Kansas, and that the total. indebtedness of said city, including this issue of bonds, does not exceed any constitutional or statutory limitations, IN WITNESS WHEREOF, the City of Salina, Kansas, by its Mayor and Council, has caused this bond to be signed by its Mayor and attested,by its City Clerk, and its corporate seal to be hereto Ll 1 1 1 s PAY 1 1 1 1 453 aff ixed and this bond to be dated on the f irst day of January, 1916. INTEREST COU PON On the first day of , 19—, the city of Sa- lina, Kansas will pay to the bearer Dollars at the fis- cal agency of the State of Kansas, in the City of Topeka, Kansas, being six months interest on its improvement bond dated January 1st, 1916, and number . , City Clerk Sec. 6. The Mayor and City Clerk are hereby authorized and directed to prepare and execute said bonds and coupons, as in this ordinance provided, and when executed said bonds shall be registered with the city clerk of the City of Salina, and with the Auditor of the State of Kansas, as required by law, and shall be, by the Mayor of said City, delivered to the contractor or contract- ors constructing said improvements, in proportion to the amounts due such contractors, respectively, in payment of the amounts due them for such work and improvements; Provided, however, that such bonds shall not be sold or delivered to such contractors at less than their par value nor in a greater sun or amount than the whole amount due and . owing such contractors under their respective contracts with said city for the making of said improvements; And, provided further, that the mayor and council may sell said bonds at not less than their par value and out of the proceeds thereof pay said contractors for said work and improvements, and that the mayor and council shall annually make provision for the payment of the principal and interest of said bonds as they severally become due, by levying a tax on the property liable therefor.
