1913 Secure Depot Right-of-WayORDINANCE N 0 . 1913 (Published in the Salina Evening Journal January 4th, 1916) An ordinance providing for the issuance of Ten Thousand (10,000.00) Dollars of the bonds of the City of Salina, Kansas, to aid the Sa- lina Northern Railroad Company in securing and paying for right-of- way, depot grounds and terminal facilities in the City of Salina, Kansas Be it ordained by the Mayor and Councilmen of the City of Salina, Kansas Section 1. THAT WHEREAS on the 7th day of December, A. D..1914, the mayor and.council of the City of Salina, Kansas, duly passed, approved and caused to be published a certain Ordinance of said City, numbered 1804 and entitled, "An ordinance calling a Special Elec - . tion of the City of Salina,- Kansas, for the purpose of submitting to the .qualified electors thereof, the question whether the said City of Salina, Kansas, shall issue it's bonds in the sum of Twenty Thous- and $20,000.00) Dollars to aid the Salina Northern Railroad Company in securing and paying for right-of-way, depot grounds, and terminal facilities in the City of Salina, Kansas", And WHEREAS, after the passage of said Ordinance, the said Mayor and Council of said City caused notice to be given that said election as ,provided for in said ordinance, should be held in said City of i Salina, at the usual places for holding elections on the 4th day of January, A. D. 1915, and that the polls should be opened at eight I o'clock A. M • of said day, and closed at six O'clock P • M • of said i day, for the purpose of determining by the legal: voters of the said City of Salina, Kansas, the acceptance or rejection of the proposal set forth in said Ordinance, And IIHEREAS� on the said 4th day of January, 1:915, said Election was.duly held in said City pursuant to the said 'notice and Procla- mation aforesaid. And WHEREAS, on the 8th day of January, 1915, the mayor and council of the city of Salina, Kansas met at the council chamber in said I City purusant to the Statute in such case made and provided, and duly canvassed the vote cast at said election; and as such Board of i Canvassers, found and determined that at the said election so Yield as aforesaid, it was found and determined by the; returns of said election., that the proposition was duly carried 'at said election., by a majority of the legal voters of. said City voting at said election, voting in favor thereof, and that at said specia!1 election., that there was cast for said proposition five hundred f ifty (550) votes, and there were cast against said proposition one: hundred fifty-five (155) votes; and that said proposition duly and legally carried by a I majortiy od three hindred fifty-five (355) votes! cast at said elec- t ion. And 1 1 1 I PAY i 1 1 1 1 WHEREAS, it was provided in the petition for said election a and the ordinance and proclamation passed, approved and given in pursuance thereof, that there be submitted to the qualified voters of said City the following proposition: Shall the City of Salina, Kansas, issue to the said The Sa- lina Northern. Railroad Company forty (40) of the bonds of said City of the denomination of Five Dundred ($500.00) Dollars each, said bonds to be payable to bearer at the office of the Treasurer Of the State of Kansas, in the. City of Topeka, Kansas, thirty (30) years after the date thereof, bearing interest at the rate of five per cent per annum, interest payable semi-annually, for which inter- est coupons shall be attached, payable at the office of the Treas- urer of the State of Kansas, at the said City of Topeka, in the State of Kansas. Said bonds aforesaid, to be issued upon the following condi- tions namely: That when the said Railroad shall have been built and construct - ed and in operation by lease or otherwise, from a point at or near the west end of Elm Street, in said City of Salina, Kansas, to Lin- coln,, Center, Kansas, and adequate side tracks and switching facilii - ties built and constructed in said City of Salina, Kansas, then the Mayor and Council of said City of Salina, Kansas, shall cause one- half in number and amount of such bonds, with coupons attached as aforesaid, to be issued in the name of said City of Salina, Kansas, and shall deliver the same to said Railroad Company provided that said railroad shall have been built and completed and in operation by lease or otherwise as aforesaid to Lincoln Center, Kansas, on or before the 31st day of December, A. D-1915., and when said railroad shall have been built and constructed and in operation by lease or otherwise from the said City of Salina, Kansas, to the city of Osborne, Kansas, then the mayor and council of said City of Salina, Kansas, shall cause the other one half in number and amount of such bonds, with coupons attached, as aforesaid to be . issued in the name of said City of Salina, Kansas, and shall deliver the same to said Railroad Company, provided, that said Railroad shall be built and completed and in operation by lease or otherwise as aforesaid to the said City of Osborne, Kansas, on or before the 31st day of De- cember, A. D. 1916, and, .W.HEREAS, it has been shown to said mayor and council, and said mayor and council do hereby find, determine and declare that rms the said railroad of said Railroad Company, before the first day of January 1916, was substantially built and constructed, complet- ed and in operation, from a point at or near the west end of Elm Street, in said city of Salina, Kansas, to Lit icoln Center, Kansas, and that adequate side tracks and switching facilities had been built and constructed in said city of Salina, ,Kansas, and that said Railroad Company, had in all respects fully complied with the con- ditions contained in said ordinance, which was requisite and nec- essary as a condition precedent for it to comply with before the issuance of one half of said bonds as hereinbefore set forth. Sec. -2. That the Mayor and City Clerk of said City are here- by ordered and .directed to cause to be prepareld, executed and de- livered to the said Railroad Company, twenty (20) of the bonds of the said City of .Salina, Kansas, of the denomination of Five Hun- dred($500.00) Dollars, each, with interest thereon at the rate of five per cent per annum, and dated on the f irsIt day of January, A. D. 1916; which said bonds so to be made, executed and delivered as aforesaid, shall be of the substantial form as follows: UNITED STATES OF ANTER ICA . STATE OF KANSAS, COUNTY OF SAL INE . OF THE CITY OF SAL INA , KANSSAS KNOW ALL MEN BY 'THESE PRESENTS: That the Cit o City of Salina, in the County y of Saline and State of Kansas, for value received, hereby promises'', and agrees to pay to the bearer at the office of the Treasurer of the State of Kansas, in the City of Topeka, State of Kansas, thirtyi (30) years after the date hereof, the sum of FIVE HUNDRED DOLLARS. ($500.00), with interest thereon from the dated hereof until maturity at the rate of five per cent per annum, payable semi-annually on the first day of July and January of each year at the office of the State Treasurer of the Stateof Kansas, in the City of Topeka, State of Kansas, on presentation of the proper coupons hereto attached as they severally become due. This bond is redeemable at the will of the City of Salina, Saline County, Kansas, at any time after ten (10) years from the date of its issuance, and is one of a series of twenty (20) bonds, numbered from one to twenty, inclusive, and amounting in the aggre- gate to Ten Thousand ($10,000.00) Dollars, issued to The Salina Northern Railroad Company, a corporation, organized and existing and doing business under the lawd of the State of Kansas; pursuant to the provisions contained in Paragraphs 7049, 7050, 7051, 7052, 7053, 7054 and 622 of the General Statutes of the State of Kansas, for the year 1909. 1 1 Ci IIt"AY 1 1 1 The provisions and requirements of said Acts and the condi- tions and requirements precedent necessary to the. lawful issuance of this bond, have been in all respects fully and completely com- plied with and performed; and the total indebtedness of said city, including this series of bonds, does not exceed the Constitution- al onstitution- al or Statutory Limitations And it is hereby certified and recited that a sufficient tax to pay both interest and principal of this bond, at their re- spective maturities will be levied and collected, and in payment thereof applied as provided by law.
