An ordinance providing for the opening and extending of Twelfth
Street, in the city of Salina, Kansas.
WHEREAS, as part of the consideration for the location, con-
struction, operation and maintenance of a Union Depot in the City
of Salina, Kansas, by' The Union Pacific Railroad Company, The At-
chison, Topeka & Santa Fe Railway Company, The Chicago, Rock Island
& Pacific Railway Company and The Missouri Pacific Railway Company,
it was mutually agreed between the City of Salina and the above
named Railroad Companies, that Twelfth Street should be opened as '
hereinafter described, from the north line of Bishop Street (pro-
duced) to the south line of North Street, across property principal-
ly owned by such Railroad Compan;tes, described hereinafter.
AND WHEREAS, The Missouri Pacific Railway Company is the pres-
ent owner of the following described parcel of land:
#1. Beginning at a point in the North line of Bishop Street -
Ninety -five (95) Feet West from the west line of Eleventh Street;
thence west along said North line (produced) of Bishop Street a
distance of One Hundred Forty-one and Four -tenths (141.4) feet to
a point; thence northwesterly, with an angle of Sixty-six (66)
Degrees and Forty-eight (48) Minutes to the right, a distance of
Twenty-seven and Seven -tenths (27.7) feet to a point in the south-
easterly line of the or'ignal right of way of The Atchison, Topeka
& Santa Fe Railway Company; thence northeasterly along said line of
original right of way a distance of Thirty-eight and Two-tenths
(38.2) feet, more or less, to a point; thence east along a line
parallel with and Thirty-three (33) feet distant north from said
north line (produced) of Bishop Street a distance of One Hundred and
Nine -tenths (100.9) Feet, more or less, to a point; thence south-
easterly, with an angle of sixty-six (66) Degrees and Forty-eight
(48) Minutes to the right, a distance thirty-five and nine -tenths
(35.9) feet to the point of beginning.
The above described tract is a portion of the land required
for the opening of Twelfth Street, as described in this ordinance
and is herein referred to as Tract Number One (1) .
WHEREAS, The Chicago, dock Island & Pacific Railway Company is
the present owner of the following described ,parcel of land:
#2. Commencing at a point in the north line of Bishop Street,
Ninety-five (95) feet west from the west line of Eleventh Street;.
thence northwesterly, along a line which makes a northwesterly angle
of sixty-six (66) Degrees and Forty-eight (48) Minutes.. a distance
of Thirty-five and Nine -tenths (35.9) Feet to the point of beginning;
thence continuing northwesterly, along the last above described
line, a distance of Twenty and Two-tenths (20.2) Feet, more or less,
to the intersection with the southeasterly right of way of the
Atchison, Topeka & Santa Fe Railway Company; thence southwesterly,
with an angle of Seventy-eight (78) Degrees and Eight (8) Minutes
to the left, along the said southeasterly right of way line of the
said The Atchison, Topeka & Santa Fe Railway Company, a distance of
Ninety-four and six -tenths (94.6) Feet; thence East along a line
parallel with and Thirty-three (33) Feet distant dorth from the
said North line (produced) of Bishop Street a distance of One Hundred

City of Salina, as platted and recorded, lying between the south line
of North Street and a line parallel with and distant Fifty (50)
feet Southeasterly at right angles from the center line of the main
track of the Union Pacific Railroad, as now located and constructed.
#3. Commencing at a point in- the North line of Bishop Street,
Ninety-five (95) Feet west from the west line of Elevuenth Street;
thence northwesterly, along a line which makes a northwesterly
angle of sixty-six (66) degrees and Forty-eight (48) Minutes, with
the said North line of Bishop Street, a distance of Fifty-six and
One-tenth (56.1') Feet, more or less, to the intersection with the
southeasterly right of way line of The Atchison, Topeka & Santa Fe
Railway Company for point of beginning; thence continuing northwest-
erly, along the last above-described line, a distance of ninety-five

Minutes to the left, along the said Southeasterly right of way line

point of beginning, containing an area of Twelve Thousand Three Hun-

for the opening of Twelfth Street, as described in this ordinance
and is herein referred to as Tract Number Three (3) .

Twelfth Street in said City of Salina, which said point is Fifty (50)
feet Southeasterly from, when measured at right angles to the center
line of the main track of the Union Pacific Railroad Company; thence

one and Six -tenths (21.6) feet to a point; thence southeasterly, mak-
ing an angle of Twenty-three (23) Degrees and Twelve (12) Minutes
to the left with the next preceding course, a distance of One Hundred
Fourteen and Seven -tenths (114.7) feet, more or less, to a point
in the southeasterly property line of the Union Pacific Railroad
Company, which said point is One hundred Fifty -Four and Eight -tenths
(154.8) feet southwesterly, when measured along said southeasterly
property line, from the west line of the alley between Eleventh
Street and Twelfth Street ; thence Northeasterly along said South-

WHEREAS; The Union Pacific Railroad Company is the present
owner of the following described parcels of land:
#6 . All that part of Twelfth Street in Depot Addition to the
City of Salina, as platted and recorded, lying between the south line
of North Street and a line parallel with and distant Fifty (50)
feet Southeasterly at right angles from the center line of the main
track of the Union Pacific Railroad, as now located and constructed.
Also, beginning'at a point in the West line of said Twelfth
Street (produced), Fifty (50) Feet southeasterly from, when meas-
ured at right angles to, the said center line of said main track -of
the Union Pacific Railroad; thence Southeasterly along a straight
line with a southeasterly angle of Fifty -One (51) Degrees and Twenty-
five (25) Minutes with a line which is parallel with -and distant
Fifty (50) Feet Southeasterly at right angles from the said center
line of said main track of the Union Pacific Railroad, a distance of
One Hundred Nineteen and .One -Tenth (119.1) Feet to a point; thence
northeasterly along a line making an angle to the left of One Hundred
Forty-three (143) Degrees and Seven (7) Minutes, with last described
course, a distance of Fifty -Nine (59) Feet, more or less, to a point
in the east line (produced) of said Twelfth Street; thence north
along said east line (produced) of said Twelfth Street to a point in
the said line, which is parallel with and Fifty (50) Feet distant
.Southeasterly from said center line of main track; thence southwest-
erly along said line parallel with and Fifty (50) Feet distant south-
easterly from said center line of said main track a distance of
Eight -six (86) Feet, more or less, to the point of beginning.
The above described tracts are a portion of the land required
for the opening of Twelfth Street, as described in this Ordinance,
and are herein referred to as Tracts Numbered Five (5) and Six (6).
AND WHEREAS, the owners of the above tracts Numbered One (1),
Two (2), Three (3), Five (5) and Six (6), have agreed to waive any
claims for damages resulting to them on account of the opening of
said Twelfth Street, as herein set forth and described; Now, There-
fore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That Twelfth Street in the City of Salina, Kansas,
be and the same is hereby opened and extended from the north line of
Bishop Street to the South line of North Street; as herein more parti-
cularly described as follows, to -wit:
Beginning at a point in the north line of Bishop Street, Ninety-
five (95) Feet West from the west line of Eleventh Street, when meas-
ured along the said North line of Bishop Street; thence northwest-

tenths (237.6) Feet to a point in. the North line of Bishop Street,
which is Thirteen and Six -tenths (13.6) Feet East from the east line
of Twelfth Street, when measured along the said North line of Bishop
Street; thence East, along the said _North line of Bishop Street, One
Hundred Forty-one and Four -tenths (141.4) Feet, more or less, to

Sec. 2 That in the event that such above portion of Twelfth
Street is ever vacated or discontinued as a public highway, then Tract
#1, above described, shall revert to and become the property of The
Missouri Pacific Railway Company, it successors or assigns; Tract #2,
above described, shall revert to and become the property of The Chica-
go, Rock Island & Pacific Railway Company, its successors or assigns;
Tract +3, .above described, shall revert to and become the property of
The Atebison, Topeka & Santa Fe Railway Company, its successors or
assigns; Tract k4, above described, shall revert to and become the
property of the owners of the abutting property; Tracts Numbered Five
(5) and Six (6), above described, shall revert to and become the pro-
perty of The Union Pacific Railroad Company, its successors or assigns.
Sec. 3. This Ordinance shall take effect and be in force from
and after its approval by the above named Companies and their execu-
tion, by the proper officers, of the attached waivers of damage and its
publication once in The Salina Evening Journal.

Thirty-seven and:Six-tenths (237.6) Feet to a point in the North line
of Bishop Street, which is Thirteen and Six -tenths (13.6) Feet East
from the East line of Twelfth Street, when -measured along the said
North line of Bishop Street; thence East, along the said North line
of Bishop Street, One Hundred Forty-one and Four tenths (141.4) Feet,
more or less, to point of beginning.
Section 2. That in the event that such above portion of Twelfth
Street is ever -vacated or discontinued as a public highway,,then Tract
1, above described, shall revert to and become the property of The
Missouri Pacific Railway Company,.ite.successors or assigns;.Tract ,._.
above described, shall revert to and become the property of The Chicago,
_Rock Island & Pacific Railway Company, its successors or assigns; Tract
3, above described,.shall revert to and become the property of The
.Atchison, Topeka & -Santa Fe Railway Company, its successors or assigns;
Tract #4, above described, shall revert to and become the property -of
the owners of the abutting property; Tracts Numbered Five (5) and -Six
(6), above described, shall revert to and become the property of The
Union Pacific Railroad Company* its successors or assigns.
Section 3, This Ordinance shall take effect and be in force from
and after its approval by the above named'Companies and their execution,
of the attached waivers of damage and its pubs.
