An ordinance providing for the paving and excavating of Eleventh
Street, in the City of Salina, Kansas; between the south line
of Walnut Street -and the north line of South Street, speQify-
ing and selecting the material -to be used, letting the contract
for such paving and excavating, providing for the cost there-
of and specifying the manner of payment.
WHEREAS, two parallel streets in the city of Salina, to -wit:
Walnut Street between Front Street and College Avenue and South Street
between Fourth Street and College Avenue, have been graded, curbed,
guttered and paved, and,
WHEREAS, Eleventh Street in said City is an intervening con -
netting street between the graded, curbed, guttered and paved port-
ions of said Walnut Street and South Street; and,
WHEREAS, said intervening portion of said Eleventh Street has
been graded, curbed and guttered but has not been paved; therefore.,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the Mayor and Council deem it necessary and
it is necessary and hereby ordered that Eleventh Street in the City
of Salina, Kansas, between the south line of Walnut Street and the
north line of South Street be paved with one course of vitrified ver-
tical fiber side wire cut Buffalo Brick Block paving material, with
Asphalt Filler, on a five inch concrete base, as specified in the
plans and specifications of the city engineer of said city for the
making of such improvement, whc ih plans and s pec if iectat ions are now
on file with .the city clerk of said City, and are hereby adopted and
approved as and for the plans and specifications for the making of
the improvements herein provided for, and such plans and specifica-
tions are hereby made a part of this ordinance.
Sec. 2. All excavating, rolling and filling necessary for the
proper construction of such pavement shall be done and such paving
shall be constructed on and according to the established grade of said
Eleventh Street.
get. 3. That a contract be and is hereby let to Watts & Amer-
man for the ' paving and excavating of said street within the limits
defined herein, at and for the following prices, to -wit: for paving
said street with the paving material specified in Section One {1)
hereof, with asphalt filler, placed on a five inch concrete base,
One and 72/100 Dollars, ($1.72) per square yard for the square yards
of such pavement actually laid and put in place on said street, and
for the excavating necessary to properly construct such paving, such
contractor shall be paid at the rate of thirty-three cents (33¢)

per cubic yard for the cubic yards of dirt actually removed from
said' .street , all as computed and measured by the city engineer of
said City. The above prices are found to be less than the esti-
mated cost of such improvement as made by the City Engineer and now
on file with the City Clerk.
Sec. 4. That such contract is awarded with the express con-
dition that the work and improvement thus provided for shall be
done in strict accordance with the specifications of the City Engin-
eer therefor, and upon the further condition that the said Watts &
Amerman will give to the City a surety bond, in the approximate
sum of the cost of such improvement, guaranteeing such pavement a-
gainst all defects for the period of five years after its acceptance
by the Mayor and Council, and such contractors shall also give a
good and sufficient bond as required by the Statutes of the State
of Kansas, both such bonds to be approved as to form by the City At-
torney and as to sufficiency by the Mayor.
Sec. 5. Said street shall be paved thirty-six (36) feet in
width, except that at the intersection of streets and alleys such
paving shall return to the lot line of said street.
Sec. 6. After the passage and publication of this ordinance
the Mayor and Council shall appoint three disinterested appraisers
who, after having. taken an oath to faithfully and impartially ap-
praise all lots and pieces of grojnd liable to taxation and assess-
ment for the cost of the said improvements, shall, within ten days
after having been notified of their appointment, proviceed to appraise
said lots and pieces of ground liable to assessment and taxation,
as aforesaid, without regard to the buildings or improvements there-
on, and after making said appraisement shall return the same to the
mayor and council at the first meeting thereof after such appraise-
ment shall have been made and completed, and after said appraise-
ment is returned to the city council, the mayor and council shall
designate a time for holding a special session for the purpose of
hearing complaints and equalizing said appraisement, of which special
session due notice shall be given in the official city paper; and
at such special session the mayor and council shall, if they deem it
just and. proper, alter or change such appraisement:
See. 7. For the purpose of paying for the work and improve-
ment in this ordinance specified, the mayor and council are hereby
authorized and directed to issue bonds of the City of Salina, in an
amount not to exceed the cost of such improvements, and to run for
a period of ten years and payable in ten equal annual installments,
together with interest not to exceed five per cent per annum, which
bonds shall be made payable at the Fiscal Agency of the Mate of
Kansas; and for the purpose of paying principal and interest on said
bonds as they severally become due the mayor and council shall by
ordinance apportion and assess against the lots and pieces of ground
in the taxing district of such improvements special assessments cov-
ering the cost ofsaid improvements, and the apportionment therein con-
tained shall hold good for all the installments that are to be col-
lected from the specific -'property chargeable with such improvements.
Such assessment and apportionment ordinance shall contain the total
amount of tax apportioned to each tract, piece and parcel of land
within the taxing district, and shall state the number of annual in-
stallments in which such tax is .to be collected; and thereafter the
city clerk shall annually, at the same time other taxes are to be
certified, certify to the county clerk of Saline County, Kansas, a
full list of all property liable for the cost of such work and im-
provements, together with the respective amounts due on each of said
tracts, pieces and parcels of land, which amount shall include the an-
nual installments and the interest on all unpaid balances for one
year at the rate of five per cent per annum,, and such amounts so certi-
fied shall be collected as other taxes are collected; Provided, that
for the purpose of defraying the cost of improving the squares and
areas formed by the crossing of streets and alleys, as well as where
the improvement is through or adjacent to property of the City, for
which the.City would be liable, the assessments shall be made against
all taxable property of the City.
Sec. 8. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.

paved portions of said Walnut Street and South Street; and,
Whereas said intervening portion of said Eleventh Street
has been graded, curbed and guttered but haw,not been paved;
therfore,
Be it ordained by the Mayor and Councilmen of the Ci" of Salina:
Section 1. That the Mayor and Council deem it necessary and
it is necessary and hereby ordered that Eleventh Street in the
City of Salina, Kansas, between the-$outh line of Walnut Street
and the north line ofSouth Street be Paved with one course of
vitrified vertical finer side wire cut Buffalo brick block paving
material, with asphalt filler, on a five inch concrete base, as
specified- in the plans .and-spac_ifications-of _ the:.. city, engineer of
said city for the making of such improvement which plans and
specifications are now on file with the city clerk of said city
and are hereby adopted and approved as and for the plans and
specifications for the making of the improvements herein provided
for, and such plans and specifications are hereby made a part of
this ordinance.
Section 2. All excavating,rolling and filling necessary
for the p3pper construction of such pavement shall be done and

such paving shall be constructed on and according to the estab-
lished grade of said llth Street.
Section 3. That a contract be and is hereby let to Watts &
Amerman for the paving and excavating of said street within the
limits defined herein, at and for the following price's, towit;
for paving said street with the paving material specified in
section one hereof,with asphalt filler, placed on.a five inch
concrete base, One and 72/100 Dollars ($1.72) per square yard
for the square yards of such pavement actually laid and put in
plane 6n said steeet, and, for the excavating necessary to
properly construct such paving, such contractor shall be paid
at the rate of thirty-three cants (33¢) per cubic yard for the
cubic yards of dirt actually removed from said street, all as
computed and measured by the city engineer of said city. The
above prices are hereby found to be less than the estimated
cost of such improvement as made by the city engineer and now on
file with the city clerk.
Section 4. That such contract is awarded with the express
condition that the work and improvement thus provided for shall
be done in 4trict accordance with the specifications of the city
engineer therefor, and upon the further condition that the said
Watts & Amerman will give to the city a surety bond, in the
aproximate sum of the cost of such improvement, guaranteeing such
pavement against all defects for the period of five_ years after
its acceptance by the mayor and council and such contractors shall
also give a good and sufficient bond as required by the statutes
of the state of Kansas, both such bonds to be approved as to form
by the city attorney and a_,s4 sufficiency by the_ Mayor.
Section 5. 544d street shall be paved thirty six feet in
width except thgt4the intersection of streets and alleys such
paving shall return to the lot line of said street.

Sec. This ordinance shall take effect and be in force
