ORDINANCE NO. 1895. -

An ordinance letting the contract for the cuhbing and guttering of
certain portions of State Street,, -Mulberry Street, Walnut
Street, Chicago Street and Ash Street, in the city of -Salina,
Kansas.
WHEREAS, by resolutions duly adopted on the 3rd day of May,
1915, and the 2nd day of August, 1915, the mayor and council of the
city of Salina, Kansas, have declared that they deemed it necessary
to curb and gutter the above named streets; and,
WHEREAS, under the provisions of Ordinance No. 1868, passed
and approved August 7th, 1915, and Ordinance No, 18760 passed and ap-
proved September 6th, 1915, the mayor and* council determined to curb
and gutter Ash Street in the City of Salina, on both sides thereof,
between the east line of Fourth Street and the west line of Ohio
Street; State Street in the City of Salina on both sides thereof, bet-
ween the east line of the right-of-way of the Missouri Pacific Rail-
way Company and the west line of College Avenue; Mulberry Strebt in
the City of Salina, on booth sides thereof, between the east line of
Santa Fe Avenue and the west line of Second Street; Walnut Street in
the City of Salina, on both sides thereof, between the east line of
the right-of-way of the Missouri Pacific Railway Company and the
west line of College Avenue; Chicago Street in the City of Salina,
on both sides thereof, between the north line of Walnut Street and
the south line of State Street; and State Street in the City of Salina,
on the south side thereof, between the west line of Railroad Street
and the east line of Olive Street; and,
WHEREAS, plans and specifications for the making of said im-
provements have been made by the City Engineer and filed with the
City Clerk, and the same have been adopted and approved by the mayor
and city council; and,
WHEREAS, proposals for doing such curbing and guttering have
been filed with the city clerk, and said proposals have been examined
by the mayor and council, and the proposal.or bid og Watts & Amerman
is hereby found to be the most saitsfactory proposal for the curbing
and guttering of said streets, and the prices named in such proposal
are hereby found to be less than the estimated cost of making such
improvements as heretofore made by the city engineer, which estimate
of the city engineer is now on file with the city clerk; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. That the curbing and guttering of said Ash Street
within the limits hereinbefore defined, shall be so constructed that
the lot line edges of such curbing shall be set twenty-four (24)
feet from and parallel with the center line of said street.
See. 2. That the curbing and guttering of said State Street,
between the east line of the right-of-way of the Missouri Pacific
Railway Company and the west line of College Avenue, shall be so con -
strutted that the lot line edges of such curbing shall be set eight-
een and one-half (182) feet from and parallel with the center line
of said street.
Sec...3. That the curbing and guttering of said Mulberry.
Street, between the limits hereinbefore defined, shall be so con-
structed that the lot line edges of such curbing shall be set twen-
ty-four (24) feet from and parallel with the center line of said
street.
Sec. 4. That the tubbing and guttering of said Walnut Street,
within the limits hereinbefore defined, shall be so constructed
that the lot line edges of such curbing shall be set nineteen (19)
feet from and parallel with the tenter line of said street.
Sec. 5. That the curbing and gutteringof said Chicago Strebt,
within the limits hereinbefore defined, shall be so constructed that
the lot line edges of such curbing shall be set eighteen (18) feet
from and parallel with the center line of said street.
Sec. 6. That the curbing and guttering of said State Street,
on the south side thereof, between the west line of Railraod Street
and the east line of Olive Street shall be so constructed that the
lot line edges of such curbing shall be set eighteen and one-half
(182) feet from and parallel with the center line of said street.
Sec. 7. That a contract is hereby let to Watts & Amerman,
for the curbing and guttering of all of the above named streets
within the limits hereinbefore defined, at and for the uniform price
of seventy-four cents (74¢) per lineal foot for the lineal feet of
curbing and guttering actually constructed and put in place on said
streets as computed and measured by the city engineer of said city.

Sec. 8. That such contract is awarded upon the express con-
dition that the work and improvements to be done and performed there-
under shall be done in strict accordance with the specifications of the
City Engineer therefor, which are hereby made a part of this ordinance,

and in accordance with the provisions of Ordinance No. 1868 and Ord-
inance No. 1876, and of the contract hereby awarded, and that such
work and improvement shall be done in a proper and workmanlike manner;
and upon the further condition, among other, that the said Watts & Am-
erman shall execute and file with the City of Salina, within ten days
from this date, a written contract for the performance of such work
and a good and sufficient bond in the approximate sum of the cost of
such improvement, guaranteeing such curbing and guttering as in said
specifications provided, and a further bond that all calims and de-
mands for labor and material 'Used in the performance of such contract
will be paid, both of scuh bonds to have the written approval of the
mayor as to sufficiency and of the city attorney. as to form.
Sec. 9. Thid ordinance shall take effect and be in forge from
and after its publication once in the Salina Evening Journal.

filed with the city clerk, and said proposals have been examined by

the curbing and guttering of said streets, and the prices named in

therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina;
Section 1. That the.curbing and guttering of said Ash.Street
within the limits hereinbefore defined, shall be so constructed that
the lot line edges of such curbing shall be set . M. feet from and
parallel with the center line of said street.
Sec. 2. That the curbing and guttering of said State Street;,
between the east line of the right of way of the 1issouri Pacifid Rail
way Company and the west line of College Avenue, shall be so construc-
ted that the lot line edges of such curbing shall be set .18+.. feet
from and parallel with the center line of said streets
Sec. 3. ;That the curbing and guttering of said Mulberry Streets
between the limits hereinbefore defined, shall be so constructed that
the lot line edges of such curbing shall be set feet from and
parallel with the center line of said street.
Sec. 4. That the curbing and guttering of said Walnut Street,
within the limits hereinbefore defined, shall be so constructed that
the the lot line edges of such curbing shall be set ..?9.. feet from
and parallel with the center line of said street.
Sec. 5. That the curbing and guttering of said Chicago Sto eet,
within the limits hereinbefore defined, shall be so constructed that
the lot line edges of such curbing shall be set ..18... feet from and
parallel with the center line of said street.
Sec. 6.- That the curbing and guttering of said State Street,
on the south side thereof, between the west line of Rgdlroad Street
and the East line of Olive Street shall be so constAucted that the lot
