ORDINANCE N O . 18 92 .

An ordinance specifying -and selecting the paving material to be used
and letting the contract - for the paving and excavating and for
the curbing and guttering of certain portions of Park Street,
in the City of Salina.
WHEREAS, under the provisions of Ordinance No. 1877, passed
and approved September 6th, 19152 the Mayor and Council determined
to pave and excavate, and curb and gutter Park Street in the city
of Salina, Kansas, between the west line of Ninth Street and the east
line. of the right-of-way of the Missouri Pacific Railway Company, and,
WHEREAS, plans and specifications for the making of said im-
provements have been made by the City Engineer and filed with the
City Clerk,
as provided
in Ordinance No. 1877,
and the same have been
adopted and
approved by
the Mayor and Council,
and,
WHEREAS, proposals for doing such paving and excavating, and
such curbing and guttering have been filed with the City Clerk, and
such proposals have been examined by the Mayor and Council, and the
proposal or bid of Watts & Amerman is hereby found and determined to
be the moat satisfactory proposal for the kind and character of pave-
ment hereinafter designated and selected, and that the prices named
in such proposal are found to be less than the estimated cost of each
of such improvements as heretofore made by the City Engineer, and
now on file with the City Clerk; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Section 1. The Mayor and Council hereby determine that said
Park Street, between the west line of Ninth Street, and the east line
of the right-of-way of the Missouri Pacific Railway Company shall be
paved with one -course vitrified vertical fiber side wire out Buffalo
trick Block, as specified in the specifications of the City Engineer,
filed by him with the City Clerk on the 20th day of September, 1915;
and such paving material as aforesaid laid on a five (5) inch con-
crete base, as specified, is hereby adopted -and selected as the materi-
al with whcih such street shall be paved. Such paving shall be thir-
ty-six (36) feet in width from the west line of Ninth Street to Thir-
teenth Street and thirty-three (33) feet in width from the west line
of Thirteenth Street to the right-of-way of the Missouri Pacific Rail-
way Company, except that at the intersections of streets and alleys
such paving shall extend from lot line to lot line on said street.

Sec 2. That the curbing and guttering of said street as pro-
vided in Ordinance No. 1877, shall be so constructed on said Park
Street between the west line of Ninth Street to the east line of
Thirteenth Street, that the lot line edges of such curbing shall be
set twenty and one-half (201) feet from and parallel with the center
line of said street, and between the west line of Thirteenth Street
-to the right-of-way of the Missouri Pacific Railway Company, such curb
shall be so constructed that the lot line edges of such curbing shall
be set nineteen (19) feet from and parallel with the center line of
said street; Provided, that at the intersectons of streets and alleys
such curbing and guttering shall return to the lot line on said street.

See. 3. All excavating, filling and rolling necessary for the
proper construction of such improvements shall be done and all of said
improvements shall be made and done in conformity to and compliance
with the plans and specifications therf or made by the city engineer and
now on file with the City Clerk, and such plans and specifications are
hereby incorporated and made a part of this ordinance in all respects
as if the same were written out in full herein.
Sec. 4. That a contract be and is hereby awarded to Watts &
Amerman, for the paving and excavating of said Park Street, between
the limits aforesaid, with the material specified in Section One (1)
hereof, on a five inch concrete base, at and for the uniform price
of One and 91/100 Dollars, 01.91) per square yard, for the square
yards of pavement actually laid and put in place between the west line
of Ninth Street and the east line of Thirteenth Street, and One and
84/100 Dollars, 01.84) per square yard for the square yards of pavement
actually laid and put in place between the east line of the flight -of -
way of the Missouri Pacific Railway Company and the west line of Thirt-
eenth Street, and for the excavation.necessary to properly construct
said improvements, said contractors shall be paid thirty-three X33¢)
cents per cubic yard for the cubic yards of dirt actually removed from
said street where no street car line is upon such street and forty-five
(45¢) cents per cubic yard for the cubic yards of dirt actually re-
moved from said street where a street car line is located upon such
street; and that a further contract is hereby let to said Watts & Amer-
man for the curbing and guttering of said street, as above defined, at
and for the uniform price of sixty-two (620 cents per lineal foot for
the lineal feet of curbing and guttering actually laid and put in place
upon said street; all as measured by the City Engineer of said City; and
the Mayor and Council hereby determine and find that the price hereby
agreed to be paid for the improvements aforesaid are less than the
estimated prices and cost of each and all of said improvements as
made and furnished by the said City Engineer, which estimated cost
of each and all of such improvements as made by said City Engineer is
now on file with the City Clerk.
Sec. 5. That such contracts are awarded upon the express con-
dition that such work and improvement shall be done in strict accord-
ance with the specifications of the City Engineer therefor, which are
hereby made a part of this ordinance and of the contract hereby awarded;
and upon the further condition among others that the said Watts.& Amer-
man shall give to the City a surety bond in the approximate sum of
the cost of such improvements, guaranteeing -such pavement against all
defects for a period of five (5) years, and such curb and gutter for
a period of two (2) years, after such paving and curbing, and gutter-
ing shall be completed and accepted by the City.
See. 6. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.

ic Railway Company) except that at the intersections of streets and
alleys such paving shall extend from lot line to lot line on said
street.

& Amerman for the curbing and guttering of said street, as above de-
fined, at and for the uniform price of sixty-two (62¢) cents per lineal
foot for the lineal feet of curbing and guttering actually laid and
put in place upon said street; all as measured by the City Engineer
of said City; and the Mayor and Council hereby determine and find
that the price hereby agreed to be paid for the improvements aforesaid are
less than the estimated prices and cost of each and all of said im-
provements as made and furnished by the said City Engineer, whcih
estimated cost of each and all of such improvements as made by said City
Engineer in now on file with the City Clerk.
Sec. 5. That such contracts are awarded upon the express con-

for a period ' of two (2) years, after such paving, and curbing and
guttering shall be completed and.accepted by the City.'
Sec. 6. This ordinance shall take effect and be in force
from and after its publication once in the Salina Evening Journal.
