ORDINANCE N0. 1891

An ordinance providing for ' the paving and excavating of Fifth Street,
in the city of Salina, Kansas, between the south line of Walnut
Street and the north line of Prescott Avenue, specifying the man-
ner of construction, providing for the cost thereof, and the man-
ner of payment and letting the contract therefor.
WHEREAS, a petition has been presented to the mayor and council
requesting said mayor and council to pave and excavate Fifth Street,
between ,the limits hereinbefore and hereinafter specified; and,
WHEREAS, said petition has been examined by said mayor and coun-
oil and found to contain the names of a majority of the resident owners
of real property liable to taxation for such improvements; therefore,
Be it ordained by the Mayor and Councilmen of the City of Salina:
Sectionl. That it is necessary and hereby ordered that Fifth
Street in the City of Salina, between the south line of Walnut street
and the north line of Prescott Avenue, be paved with such material as
the Mayor and Council may hereafter desigante and select, as hereinafter
provided, said paving to be thirtiy-three (33) feet in width from gut-
ter to gutter; Provided, that at the intersections of streets and al-
leys such pavement shall extend to the lot line of said street.
Sec. 2. All excavating, rolling and filling necessary for the
proper construction of such improvements shall be done, and such pav-
ing shall be constructed on and according to the established grade of
said Fifth Street, as heretofore or hereafter established by the ord-
inances of said City.
Sec. 3. That such street shall be paved with one -course of vit-
rified, vertical fiber, side wire out Buffalo Brick Block paving mater-
ial, as specified in the specifications of the City Engineer for the
making of such improvements, and such paving material, laid on a five
inch concrete base, according to the specifications of the city engin-
eer, is hereby adopted and selected as the material with which such
Fifth Street shall be paved
Sec. 4. The specifications of the City Engineer for the paving
of Park Street between the west line of Ninth Street and the right-
of-way
ight-
of-way of the Missouri Pacific Railway Company, now on file with the
City Clerk, are hereby adopted and approved as the plans and specifi-
cat ions far the paving of Fifth Street as herein provided, and such
specifications are made a part of this ordinance.
See. 5. That a, contract be and is hereby let to Watts & Amerman,
a partnership composed of J. B. Watts and M. R. Amerman, for the paving
and excavating of said Fifth Street, at and for the following prices,

to-wit: For paving said street with the paving material specified in
the preceding section three (3) -hereof., laid on a five inch concrete
base, with asphalt filler, according to the specifications of the City
Engineer, One Dollar and Eight -Four cents ($1.84) per square yard for
the square yards of such pavement actually laid and put in place on
said street, and for all excavating on said street, as specified, Thir-
ty -Three cents (33�) per cubic yard for the cubic yards of dirt actu-
ally removed from said street, which such prices are hereby found to be
less than the estimated cost of such improvements made .by the city en-
gineer and now on file with the City Clerk.
Sec. 6. After the passage and publication of this ordinance the
mayor and council shall appoint three disinterested householders who,
after having taken an oath to faithfully and impartially appraise all
lots and pieces of ground liable to taxation and assessment for the
cost of the said improvements, shall within ten days after having been
notified of their appointment, proceed to appraise said lots and pieces
of ground liable to assessment and taxation, as aforesaid, without re-
gard to the buildings or improvements thereon, and after making said
appraisement shall return the same to the mayor and council at the
first meeting thereof after such appraisement shall have been made and
completed, and after said appraisement is returned to the city council,
the mayor and council shall designate a time for holding a special
session for the purpose of hearing complaints and equalizing said ap-
praisement, of which special session due notice shall be given in the
official city paper; and at such special session the mayor and council,
shall, if they deem it just and proper, alter or change such appraise-
ment.
Sec. 7. For the purpose of paying for the work and improvements
In this ordinance specified, the mayor and council are hereby author-
ized and directed to issue bonds of the City of Salina, in an amount not
Vo exceed the cost of such improvements, and to run for a period of ten
years and payable in ten equal annual installments together with inter-
est not to exceed five per cent per annum, whiih bonds shall be made
payable at the Fiscal Agency of the State of Kansas; and for the purpose
of paying principal and interest on said bonds as they severally be-
come due a the mayor and council shall by ordinance apportion and assess
against the lots and pieces of ground in the taxing district of such
improvements. special assessments covering the cost of said improvements,
and the apportionment therein contained shall hold good for all the in-
stallments that are to be collected from the specific property chargeable
with such improvements. Such assessment and apportionment ordinance
shall contain the total amount of tax apportioned to each tract, piece

and parcel of land within the taxing district and shall state the
number of annual installments, in which such tax is to be collected;
and thereafter the city clerk, shall annually, at the same time oth-
er taxes are to be certified, certify to the county clerk of sialine
county, Kansas, a full list of all property liable for the cost of
such work and improvements, together with the respective amounts due
on each of said tracts, pieces and parcels of land, which amount shall
include the annual installments and the interest on all unpaid bal-
ances for one one year at the rate of five per cent per annum, and
and such amounts so certified shall be collected as other taxes are
collected; Provided, that for the purpose of defraying the cost of
improving the squares and areas formed by the crossing of streets and
alleys, as well as where the improvement is through or adjacent to
property of the city, for which the city would be liable, the assess-
ments shall be made against all taxable property of the City.
Sec. 8. This ordinance shall take effect and be in force from
and after its publication once in the Salina Evening Journal.
