1885 Improve Alley (Santa Fe & 5th)ORD INAN CE NO. 1885 . _(Published in the Salina Evening Journal September, _2/�,j_ , 1915.) An ordinance providing for the paving of the unpaved portion of the alley between Santa Fe Avenue and Fifth Street, north of "sh Street, specifying the manner of construction, providing for the cost thereof, and manner of payment. WHEREAS, by resolution duly adopted by the mayor and council on the 19th day of July, 1915, the mayor and council declared and now de - dare that it is necesssry to pave the unpaved portion of the alley be- tween Manta Fe Avenue and Fifth Street, north of 'Ash Street, and, WHEREAS, said resolution was published for more than five con- secutive days in the Salina Evening Journal, a daily newspaper published in said City, and, WHEREAS, a majority of the resident owners of property liable to assessment for the cost of such improvement did not, within twenty (20) days from the last , publication of such resolution, file with the City Clerk any protest against such improvement or the making of the same; therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necesssry and hereby ordered that the alley between Santa Fe Avenue and Fifth Street and between Ash Street and the alley running east and west, north of Asti Street, commencing at a point on the south line of Lot No. Seventy-three (73) on Santa Fe Avenue and Lot No. Seventy-four (74) on Fifth Street in the city of Salina, Kansas, said point being about 100 feet north of the north line of Ash Street, thence north 400 feet more or less to the north line of Lot Nol F-ifth-nine (59) on Santa Fe Avenue, and Lot No. Sixty (60) on Fifth Street, to the south line of the present alley running east and west in said block, be paved with such material as the Mayor and Council may •select, .as hereinafter provided, the full width thereof, viz; ten (10) feet . See. 2. All excavating., rolling and filling necesssry to prop- erly construct such paving shall be done, and such paving shall be constructed according Vo the established grade of said alley as pro- vided by the ordinances of said.City. Sec. 3. That the specifications for the paving of said alley and the estimated cost of the same', made and prepared by the City En- gineer, n- gineer, now on f ile with the City Clerk are hereby approved. Sec. 4. After the passage of this ordinance the clerk shall ad- vertise for bids for the construction of such paving, to be received on the 4th day of October, 1915, and after such bids are received, the Mayor and Council shall determine the kind of paving to be used in said alley and are hereby authorized to let the contract therefor. 1 1 1 [1 TPAY 1 LI 1 ii 1 367 Sec. 5. After the passage and publication of this ordinance, the mayor and council shall appoint three disinterested appraisers who, after having taken an oath to faithfully and impartially appraise all lots and pieces of. ground liable to taxation for the improvement herein provided for, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground so liable to taxation (without regard to any buildings or im- provements thereon) and after amking such appraisement, shall return the same to the mayor and council at the first meeting thereof after such appraisement shall have been made,.and after such appraisement shall have been returned, the said mayor and council shall designate a time for holding a, special session for the purpose of hearing complaint and equalizing said appraisement; of which special session the mayor and council shall, if they deem it just and proper alter or change such appraisement. Sec 6. For the purpose of paying for such improvement, the mayor and council are hereby authorized and directed to issue bonds of the City of Salina, in an amount not to exceed the contract price of such work and improvement, and run for such a period of time as the mayor and council shall determine, not to exceed ten years from their date, and made payable in equal installments in each year for the life of said bonds, together with interest not to exceed five (5) per cent per annum, and made payable at the fiscal agency of,the State of Kan- sas, and for the purpose of paying principal and interest on said bonds as they severally become due, the mayor and council shall each year dur- ing the life of the bonds levy an assessment against the lots and piec- es of ground liable to taxation for the improvements herein provided for, in an amount sufficient to pay the principal and interest for that year; and the city clerk shall certify such assessments, as they are severally made, to the county clerk of Saline county, Kansas, at the same time and in the same manner as other city taxes are certified, and said assessments shall be liable to the same penalties as all other taxes Sec. 7.
