1883 Improve Thirteenth Street358 ORDINANCE NO.--1883- (Published O.1883Published in the Salina Evening Journal September cS� 1915.) An ordinance providing for the curbing, guttering and excavating of Thirteenth Street, in the city -of Salina, Kansas, between the north line of the right-of-way of the Union Pacific Railroad Company and the south line of Grand Avenue, specifying the man- ner of construction thereof and the manner of payment. WHEREAS, there has been presented to the Mayor and Council a pe- tition requesting that Thirteenth Street, in the City of Salina, Kansas, between the north line of the right-of-way of the Union Pacific Railroad Company and the south line of Grand Avenue, be curbed and guttered on both sides thereof, and, .WHEREAS, said petition has been found, by said Mayor and Council to contain the names of a majority of the resident property owners, own- ing property on both sides of said Thirteenth Street, within the bounds hereinbefore defined, who are lidbl'61to assessment and taxation for the cost of said improvement, now therefore, Be it ordained by the Mayor and Councilmen of the City of Salina: Section 1. That it is necessary and hereby ordered that said Thirteenth Street, between the north line of the right -of-way of the Union Pacific Railroad Company, and the south line of Grand Avenue, be curbed and guttered on both sides thereof with cement curb and gutter, according to the specifications hereinafter adopted, the curb part there- of to be six (6) inches in thickness and the gutter part thereof to be forty-two (42) inches from the back edge of such curb to the paving line on said street, and the lot line edge of such curbing shall be nineteen (19) from and parallel with the center ' line of said street; Provided, that at the intersection of streets and alleys such curbing and gutter- ing shall return to the lot line of said Thirteenth Street. See. 2. All excavating., rolling and filling for the proper con- struction of such curbing and guttering shall be done, and such curb- ing and guttering shall be laid on the established grade of said Thir- teenth Street as heretofore or hereinafter established by the ordin- ances of the City of Salina. Sec. 3. That the specifications of the city engineer for the work and improvement herein specified and now on file with -the city clerk are hereby adopted as and for the specifications for the improvement of said street, and said city engineer shall file with the city clerk an estimate of the work and improvement herein provided for. Sec. 4. The city clerk shall advertise for bids for the making of the aforesaid improvements and after the receipt of such bids, if the same are found satisfactory to the mayor and council, the mayor and council may let the contract for the curbing, guttering and excavating of said street as hereinbefore described, said bids to be received and returned on or before the 4th day of October, 1915. 1 1 1 1 PAY 359 1 1 1 1 1 6ec. 5. Xfter the passage of this ordinance, the mayor and council shall appoint three disinterested householders who, after having taken an othe to faithfully and impartially appraise all lots and pieces of ground liable to taxation for the improvements herein provided, for, shall, within ten days after having been notified of their appointment, proceed to appraise said lots and pieces of ground liable to taxation for said improvements, without regard to the build- ings and improvements thereon, and after making said appraisement shall return the same to the mayor and council at the first meeting thereof after said appraisement shall have been completed, and after said ap- praisement is returned to the mayor and council, the said mayor and council shall designate a time for a special session for the purpose of hearing complaints and equalizing said appraisement, of which special session due notice shall be given in the official city paper, and at said special session, the mayor and council shall, if they deem it just and proper, alter or change such appraisement. Sec. 6. For the purpose of paying for such curbing, guttering and excavating the mayor and council are hereby authorized and direct- ed to issue bonds of the City of Salina, in an amount not to exceed the contract price and to run for such a period of time as the mayor and council shall determine, not exceeding however ten years from the date of such bonds, which bonds shall be payable in equal install- ments in each year during the life of such bonds, together with inter- est not to exceed five per cent per annum and shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying the principal and interest on said bonds as they severally be- come due, the mayor and council shall each year, during the life of such bonds, levy an assessment against the Lots and pieces of ground liable to taxation for the improvements herein provided for, in an amount sufficient to pay the principal and interest for that year; Provided, that for the cost of improving the squares and areas formed by the intersections of streets and alleys with the said Thirteenth Street, as well as where the improvement is through or adjacenet to property of the city, for which the city would be liable, the assess- ment shall be made against all the taxable property of t je City, and the City Clerk shall certify said assessment, as they are severally made to the County Clerk of Saline County, Kansas, at the same time and in the same manner as other taxes are certified, and said assessments shall be liable to the same penalties as all other taxes.
